As far as the other part goes yes they are advertising a "unlimited" service, however as a business making a loss on these customers I don't see the problem.
I do have a problem with throttling as it adversely affects applications, however usage caps are quite understandable.
As for the downloaders I'm guessing that the majority are using it to download illegal content anyway, and tbh they've no-one to blame but themselves, downloading 100s of Gb a month is a ridiculous amount of data.
