Hi,

I know this is a strange question but i bought the OEM ultimate version of vista x64 back in april, however me being stupid i have damaged my media and now the disk won't allow me to install....

How do i go about getting replacement media??

Thats not true - it doesn't matter a jot where you get the replacement media from as long as you are fully entitled to use it. If you have a COA and license key for the machine in question then its no problem.

The license is the important part, not the disk.

So as long as I have my Bioshock CD key I can walk into my local game shop and lift a copy?

What a pathetic comparison...

Your BUYING the software when you buy a game, your buying the licence to USE the software with Vista.

As he said, it matters not where the media comes from, the licence is the important factor.

Wrong. By your logic I can modify and resell Bioshock then, since I now own it.

Downloading the OEM DVD is illegal, no matter how you try and justify it to yourself. As would be breaking into OCUK and stealing a copy of OEM vista. "Sorry Spie, but I have the license". Utter Crap.

however, if you stole the copy from a shop you would also be stealing another licence, as the cd key being with the cd, so not exactly the same comparison.

No he's right. You can download vista from a number of places. The EULA is completely different to that of game software or nero or something like that. With vista you DO pay for the license as you are buying the right to use it. Not the software.

With games and everything else however you DO need to buy the software as well as the license.

He doesn't mean break into somewhere and nick a copy and use your key, he means that if he downloaded it or a mate had a cd with vista on, as long as he used HIS license which HE payed for, it's perfectly legal.

Why do you think microsoft hand out cd keys for vista like candy if an oem install buggers up?

So what legal sites can the average consumer download Vista OEM from then?

And since every Microsoft cd I've ever seen has the same "Don't make illegal copies of this CD" on it I doubt there is any.

Anyway, back OT........

If it's just a scratched disc, you can get that fixed quite easily nowadays in your high street games store.
I had a whacking great scratch on my TW07 disc for 360, took it in and it was fixed in a couple of mins, cost about £3 and now works perfectly.

It's catch 22 - you can download it from anywhere and use it, but you can't upload any of it. So bittorrent's out of the question. I'm sure Burnsy's said this a few times.

In software licensing, you never buy the software per se. You buy a license to use the software under the terms of a EULA. The media is usually a small cost on top of the license to cover manufacturing and shipping costs.

However, saying that, it is important to remember that the license is the important part as it explicitly give you the right to use the software. Without it, its piracy (a criminal offence).

Many EULAs do give you the right to make backups etc and some even give you the right to share meida with someone who is licensed. However the Windows EULA is not one of them and as csmanger correctly identified, any method of downloading the Windows software whilst uploading it breaks the EULA.
