Issue with old landlord - waiting for deposit - advice

Hi there,

I'm having some issues with my previous landlord at the moment.

My ex housemates and myself are still yet to recieve our deposits back from the old landlord. Our contract ended on 30th June this year.

We have phoned him plenty of times and keeps saying it will get done, but he still has not got it back to us after over 3 months.

The silly thing is, he was fine with the house, so he's not holding the deposit because of anything wrong with it, and said we'd be getting them all back in full. He just seems to be taking his sweet time.

Am I correct in thinking that landlords should return deposits within 10 days?

Who am I best to speak to to try and get this moving quicker?
 
its within a month, were you/are you at university?
There is somewhere you can go to for help with this, although im not quite sure because im a student, so university does everything for us if we have problems :)
 
He will be waiting for new people to move in so he can get their deposits to give to you guys.

The only option I can think of would be to file a small claims but that may get his back up and he may then "find" something wrong with the house. I suppose an alternative might be to get a solicitor to write him a letter as a reminder that furher legal action may be taken.
 
I was under the impression that the landlord was not allowed to spend the deposit, and had to put it in an account until such time as it should be returned....
 
could probably ring him up and just ask where exactly this deposit is after all this time, and that you're going to seek legal advice if it doesnt arrive within a fortnight, as im sure the tenancy agreement states it should be returned within a month of tenancy ceasing.
Just ring up and have a right go at him saying why has it really been this long, and theres how many of you, which is how much money?
 
our landlord from last year is taking liberties as well. He's the kind of landlord that you can tell is gonna be a nob the second you meet him, dont know why we went with him in the first place.

The house when we got there wasn't exactly spotless and now he is trying to charge us for stuff like "it wasn't hoovered underneath the beds" and stuff like that. Its been ages now and everytime we do what he wants, get the bills, council tax exemption etc. he asks for somethin else, he wants us all to write him a letter now stating what room we were in. Whats the point?
 
When ever i rented a place i always took photos on the day of leaving just incase
the landlord came up with some BS storey about i left the place in a mess.

About your money, pay him a vistit..
 
try sending him a "letter before action" making clear he has 7 days to pay up or you will be submitting a small claims court claim without further notice. Mention in the letter that he verbally confirmed in telephone conversations that he was satisfied with the condition the property was left in and therefore has no reason not to release your funds without further delay. Mention interest, costs, and travel expenses will be included in your court summons and this is his final chance before action. You could even download the forms off the internet, fill them out, and send him a copy with your letter just to let him know you mean business

Problem is, his new tenants moved in about an hour we left, so he can't be too short of cash.

I'm waiting to hear from my other housemates to see if they've phoned lately. I will phone him again today, and maybe tell him I'm currently seeking "legal advice", which technically I am :p

I doubt that would have been in place.

I'd give him the letter before action, and then take it to small claims :)
 
The vast majority of landlords are a bunch of money grubbing ****. I had to threaten my last one with the small claims court before he'd pay up.

He's probably delaying as long as possible hoping that you give up.
