It's that time again! Another 'whos at fault' RTI, complete with mspaint drawings!

Scenario:

Blue car is in left lane on the roundabout to turn left.

Red car is in the right lane on the roundabout to go straight over or turn right

Blue car doesnt turn left, instead goes straight over.

Red car front wing bumps the side of the blue car as this happens...

who is at fault?

What about the situation where someone cuts infront of you on a motorway and slams on the brakes and you hit them, technically its your fault for going into the back of them?

will the fact that the blue car was ahead by about a metre come in to play?

blue, although if the red driver was any good, he would have seen that the blue driver was in the wrong lane and slowed down or something instead of just hitting him.

but yeh, blue technically.

I'm with Gaz1988

That said, if I were in my artic, I'd take the same line as the Blue car, due to its size & length (that artic that is) people still try to drive into me.

Was the blue car indicating left?

I always give artics a wide birth at roundabouts - scared of getting squashed! :p

if the blue car was indicating left, it would've have been visible to the red car anyway?

yeh

Berth mate - Birth is a Women thing.:D;)

I reckon the red car should have seen the indication (if it was indicating at all)

the story behind this is that I've been trying to get my no claims off my previous policy that ended last year.

I called them many times and eventually wrote to them. I got a reply today stating I wasnt entitled to no claims discount because of an incident 2 years ago (26/11/05) at the start of the policy.

They say its a £900 claim against me, but failed to tell me. They didnt even get my side of the story. I've had literally no correspondance about it at all, as proved by their log.

So what the want now is for me to fill out an 'incident' form to see who was at fault.

I wouldn't mind if it was my fault or not... just atleast tell me if someone is claiming £900 off my insurance and give me a chance to contest it!

at the end of the policy, i was hit by an uninsured lad on a moped who ran off. This is when I cut my loses and sold the car and cancelled the policy. They stated at the time that I would be entitled to 1 years no claims discount when the incident was 'closed' - which has taken a very long time since the owner of the moped says it wasnt him riding it and no one was going to take the blame.

I'm looking to insure a fairly quick car now, and that extra years NCB would be really nice!
