Hi guys.

I got a motoring offence in April 2003. It happened in May 2002.

I can get a clean license now with the convictions taken off, but what is the procedure with insurance. Do they all ask 5 years from the date of offence or date of conviction ?

As I should be entitled to some cheaper insurance after 5years since it happened :)
 
How come the date of offence and date of conviction are almost a year apart? Was it a court appearance?
 
It depends on the offence. Some (like an SP30) are from the date of the offence, other more serious offences are from the date of conviction.

Most stay on your licence for 4 years (from date of offence, or date of conviction), some have to stay on for 11 years.

Accident offences
Offence codes AC10 to AC30 must stay on a driving licence for four years from date of offence.

Disqualified driver
Offence codes BA10 and BA30 must stay on a driving licence for four years from date of offence.

Careless driving
Offence codes CD10 to CD30 must stay on a driving licence for four years from date of offence.
Offence codes CD40 to CD70 must stay on a driving licence for eleven years from date of conviction.

Construction and use offences
Offence codes CU10 to CU80 must stay on a driving licence for four years from date of offence

Reckless/dangerous driving
Offence codes DD40 to DD80 must stay on a driving licence for four years from date of conviction.

Drink or drugs
Offence codes DR10 to DR30 must stay on a driving licence for eleven years from date of conviction.
Offence codes DR40 to DR70 must stay on a driving licence for four years from date of offence.
Offence code DR80 must stay on a driving licence for eleven years from date of conviction.
Offence code DR90 must stay on a driving licence for four years from date of offence.

Insurance offences
Offence code IN10 must stay on a driving licence for four years from date of offence.

Licence offences
Offence codes LC20 to LC50 must stay on a driving licence for four years from date of offence.

Miscellaneous offences
Offence codes MS10 to MS90 must stay on a driving licence for four years from date of offence

Motorway offences
Offence code MW10 must stay on a driving licence for four years from date of offence.

Pedestrian crossings
Offence codes PC10 to PC30 must stay on a driving licence for four years from date of offence.

Speed limits
Offence codes SP10 to SP50 must stay on a driving licence for four years from date of offence.

Traffic direction and signs
Offence codes TS10 to TS70 must stay on a driving licence for four years from date of offence.

Special code
Offence code TT99 must stay on a driving licence for four years from date of conviction.

Theft or unauthorised taking
Offence codes UT50 must stay on a driving licence for four years from date of offence.

Annoyingly I thought my SP30's could come off my licence in Jan (been on for 3 years).

But apparently I have to wait another year :(

Oh well, at least they don't count towards 'totting up' after Jan :)
 
My previous post refers mainly to having the points removed from your licence and so isn't nesessarily the same as declaring for insurance purposes.

The reason that people quote 5 years for insurance (and why insurance companies ask for 5 years of history) is because of the Rehabilitation of Offenders Act 1974

Rehabilitation of Offenders Act 1974
Please note that you are not required to disclose convictions regarded as "Spent" under the Rehabilitation of Offenders Act 1974. Our understanding of the period of time following the date of conviction after which the offence need no longer be disclosed is as follows. However, you are not to rely on this and should make your own enquiries.
If no fine or disqualification - 4 years
If a fine - 5 years
If a disqualification but no fine - Period of disqualification
Imprisonment or offender training up to 6 months - 7 years
Imprisonment or offender training up to 30 months - 10 years
Imprisonment or offender training over 30 months - Never "spent"
NB: The above are reduced by 50% if the person was aged under 17 at the date of the conviction (not the offence date).

You need to ensure that you have disclosed all motoring offences that are not "spent" under the Rehabilitation of Offenders Act. If you have been disqualified from driving due to the totting up procedure (codes on your licence: TT99, XX99, SC19, SC35) all motoring offences that led to the totting up disqualification must be disclosed if they are not deemed as "spent". Failure to do so could invalidate your policy.

Thats nice to know, as I didn't receive a fine I dont have to disclose my IN10 after four years, rather than five :)
 
I have 3 points showing on my licence been there for 7 years. Everyone I have to show my licence to immediately says "you could get them wiped off now you know mate".

Anyway, funniest licence/ban related story I've ever heard involved me: -

A colleague (now an ex-colleague funnily enough) once turned up to work a few hours late. He seemed a bit aggitated. I waited for him to get settled then I asked him where he was. He ummed and argghed a bit then spilled his guts - he'd been to court.

He'd been to court for a drink drive offence (he never even told me he'd been caught), had his licence took off him that morning, came right out of court and drove to work.

Yeh so it's 5 years for me then.

I was fully insured at the time and got done for an MS50 on an industrial estate. They threw in a free IN10 too as it would mean my insurance be void.

Ah well should be cheaper in April then.

I suspect quite a large percentage of people that have been disqualified carry on driving. :mad:

I'd always thought it was 3 years too - have an SP50 to come off (temporary roadworks on a motorway) and thought I'd get it done in 08 - will have to wait til 09 now.
