My mate has had an accident - who is to blame?

Hi, bit of a question on behalf of my mate, who's just had his car written off.


He was pulling out of a T-junction to turn right, he pulled out into the road and stayed in the first lane (as to block the traffic as it was v.busy). A bus was coming towards him in this first lane, and instead of stopping, it tried to overtake him by passing into the opposite lane, as it did this my mate pulled away and did not expect to be coming face to face with a bus in the wrong lane. He hit the front left corner of the bus - which was in the wrong lane.

His car has been written off and he's wondering what the deal is on who would be to blame? Is it both parties, or was he in the wrong for pulling out - or was the bus in the wrong for overtaking him?

Probably him for failing to give way at a junction?

Your not seriously saying he on purposely pulled half way out into a road, to block one way of traffic so he could easily pull out when the other side of the road cleared and got hit by a bus for stopping half way across a road he shouldnt have stopped on in the first place?

Ok, even though there was a significant distance between him and the oncoming bus for it to stop? I'll let him know anyway, cheers for the responses.
 
Another quick question, what do you expect him to get for the car insurance wise?

Excess is £350. It was an X reg 306 1.4i (Meridian with AC and leather seats etc) - with 75k on the clock if that makes any difference. He wants at least £1k but I said he'd probably get more than that? No?

He was taking a bit more care than it seems. I'm sure some of you have pulled out - with plenty of distance to the oncoming traffic - for the intention of them to stop. Only this time the bus went across the white line to go around him and my mate didn't expect it.

It's his fault, just unlucky really.
 
Id never pull out of a give way with the intention of stopping the rest of the traffic, as for one its simply hoping they stop, as they have right of way and your mate obviously didnt, and for second, i certianly wouldnt pull out on a bus in the hope it would stop, as bus driviers are probably some ofthe most ignorant people on the roads, and I certainly wouldnt pull out in the hope it would stop.
 
Yep, was a pretty stupid thing to do, i always wait for gaps, i value my life, and my car too much for that.

But at the end of the day, we all make mistakes, you live & learn, and the main thing is that he's ok, lets just hope he learnt his lesson.

True, there is a very busy junction here which is the only way to get out is using that kind of technique. But you certainly only do it when the traffic is so busy it's slow to a crawl and at minimum there is a gap in the lane closest to the junction, and its better even if you could wait for one of the cars to flash you to give you a gap to pull into.

Yeah, I can understand the frustration sometimes when it is busy especially if someone just blocks because they are inconsiderate.

Afaik that would be his fault for the claim, he just got unlucky with the situation.
 
I feel for you friend. Theres a very similar junction that i use every day. You HAVE to creep out as usually the traffic will stop for the red lights and the ***** who dont have any forward thinking usually stop right infront of your exit blocking you in.

No, never, I'm not that impatient :confused: If someone did that infront of me with the intention of holding up an entire lane of traffic while he waited for a gap however, it would annoy me.

It's often a similar situation turning out of my work carpark, but I know that there'll be a gap eventually

The only time I would pull out half way is that if there was plenty of space between me and the approaching cars AND I would be waiting for maybe a couple of seconds for a car to pass in the opposite lane.

You are all crazy. Have you ever driven in traffic?

How can you pull out "when there is a gap" if the traffic is solid? You need to push your way in!
Otherwise there's no way you're getting out.

Likewise, you've never driven along a quiet lane, when the opposite direction is solid, and found someone in your way trying to get into the solid lane? You wait! It's not the end of the world and its the only way they're going to get anywhere

Bus driver sounds insane.
