Need advice after caught speeding

I don't know if I have a fine yet or not, nice van on a corner after a roundabout where everyone is speeding.

The road is a dual carriageway and should be 40 not 30 -.-

Isn't the worst thing someone can say is "Well you should stick to the limit", every driver has gone over the limit at least once in the UK.

well there you go then, im proof of the fact that this statement is complete and utter tosh

as i explained earlier, the magistrates have 2 options when you're referred to them. This can happen only at 25+ over the limit

1) points and a fine. This can be be any ammount i think, and fine can be up to £1000 and is means tested. If you hear about some crim being fined £80 for doing 150, its because he only gets £70 a week benefits.

2) a ban of 14 - 56 days. If your only caught at 98mph, or in the case of the person who was doing 15mph, you'll only get the minimum 14 days. However in theory you can only be banned for up to 56 days for the speeding offence in itself, no matter how fast your going. So even at 150, for the charge of speeding, they could only ban you for 56 days

If they wanted to ban you for longer, they would need some other means. If you were doing 100+ and was generally driving irresponsibly, changling lanes, tailgaiting etc.. or just plain doing 150mph then you'd probably charge you for dangerous driving. This then means they can ban you for much longer.

Other way they can get you, is if like you me, you already had 6 points, they could issue you with another 6 points and a fine. Which then lead to you loosing your license for longer than 56 days, but under a separete offence of clocking up more than 10 points, not speeding.

Not a chance. But everyone does knock around the theory that over a ton and it's a auto 1 year ban but there are plenty of exceptions.

actually that statement is very outdated

the magistrate guidelines were changed a couple of years back. Now magistrates dont issue a ban of longer than 56 days for a charge of speeding

if they are going to ban you for longer, they are either going to have to give you enough points to loose your license under the totting up rule. I think they can give up to 9 points ?

or have the CPS bring you up on a more severe charge, such as dangerous driving.
 
One thing I forgot to mention is my license doesnt have the correct address on it. I have just moved house in December and haven't actually got around to sending it yet. One reason I didnt want to send it was I didnt want it getting lost in Christmas post. So I am going to take it to court with the paperwork to send off for change of address.

You guys think this will go down ok with the judge?

i did exactly the same thing

if you dont bring your license with you to hand in at the court, it causes problems and leads to you neeing to be summonsed etc..

i told the magistrate id not changed it because i knew id need to bring it in with me and they didnt bat an eyelid.
 
Good luck matey, must be horrible waiting for that to come. You'll be fine though, probably points, a fine and a lengthy lecture. :)

I wouldn't even mention it.

I've had the 'wrong address' on my license for years. As I've been moving around a lot I've just left my parents address on it, as I have with my banking etc. They never even questioned it in court.

As long as your insurance is correct I wouldn't worry about it.
 
Hi Guys,

Well yesterday I attended court to hear the outcome of my speeding offence (98 on an A road). Anyway I was first there and had to wait on the place opening once I got in and the rest of the criminals started to turn up I started to feel pretty nervous. I was told I would have to wait for all the lawyer cases to be heard first which was most of them. It looked an easy task if you had a lawyer doing your thing for you as all the accused had to do was sit in the doc and say nothing while the lawyer did it all, at this point I really wished I had got a lawyer. Anyway after about an hour and a half I was called up but I was actually in the toilet so the judge was waiting on me when I walked back in :)

I stood on the dock and declared my name and that I was pleading guilty then sat down while the judge read over the offence and discussed a few things with his buddies. He then asked me to stand up and asked if I had anything to say for myself. I said

"I would just like to apologise for my actions, the whole experience of coming to court has taught me a lesson not to speed again. I don’t why I was speeding that night, I can only put it down to a momentary lapse of concentration and it won’t happen again. I would just like to add that I would really miss my car if I were to be banned as I need it to get back and forth to work. Again I would just like to ay sorry"

He accepted my speech and the said it was a rather excessive speed to be doing to which I agreed then came the punishment....

6 points and £200 fine (should have been a £300 fine but due to the early plead it was reduced to £200)

Then i was free to go :)

So I reckon that’s a very good result, pretty amazed I wasn’t banned considering the speed and the previous spoeeding offence of 67 in a 40 which was also a £200 fine. Anyway that’s 9 points now so got to be careful, I got back home and started phoning round for insurance and got a 12 month fully comp quote for £452 so all is good really :)
 
Sounds like you got lucky mate. I feel for you as I know it could have been me (or any number of us countryroad drivers) who fell foul of this. Best of luck being cautious and avoiding getting the fatal few points on the scorecard.:)
 
Well done. Now you seriously can't speed again for a while! After all of this i hope you know the final blow to your license will come in the form of 32mph in a 30 from a camera or something :p Sod's law i think they call it!

I thought you are allowed 10% + 2mph? So 35mph?
