Had my foot driven over

To cut a long story short after a night out on Saturday me and a friend were stood with lots of other people on the Road waiting for a taxi. Granted I was stood on the road but I was stood next to the parked cars waiting for a taxi to come by.

Anyway there was me and my friend and a few other groups of people stood there when all of a sudden one of the parked cars reversed back and out on to the road, my friend and the other people all quickly jumped back out of the way but I did not see it which resulted in him going straight over my foot and me hitting to the floor.

My foot started bleeding over the road and the guy just sat in his car and started to blame me to which the other guys who were stood with us told him he must be joking and that he should give me and my friend a lift to the hospital. He reluctantly did although he only drove me half way and said this was as far as he would take me and we should get out and walk the rest. :rolleyes: Admittedly it was only a 10minute walk but still we hobbled down there with my foot leaving a trail of blood behind.

I got in there and got x-rayed and my big toe is broken and my toe nail was dislocated which meant I had to bear my toe being pulled around for 5mins while it was pushed back in place. Apart from that I only have cuts and bruises on my feet and knees where I hit the ground.

While booking an appointment to come back in two days to make sure the break is healing correctly the lady asked if I got his number plate which I did, she reckoned I should try claim something from his insurance... thoughts. :confused:
 
Where thers a blame theres a claim.
did he look before hitting you? sounds of it he didnt.

Sorry to hear it though, toe nail dislocated?? though sounds painfull
 
You shouldn't stand on the road, ever. Consider that if it was dark and you weren't wearing something reflective the guy might not of seen you.
 
I'm against compensation culture, but this definitely doesn't fit with that - he ran you over! Go seek legal advice and teach the idiot a lesson, no way he should get away with that, he should lose his license :mad:
 
You were standing on the road though?

I agree he shouldn't have been such an ass about it but I think you have to take some of the responsability yourself.
 
I like the way he dropped you off 10 minutes away from the hospital even though it was your foot that had been injured... :confused: His compassion overwhelms me.
 
Well with this claim culture its kind of swings and roundabouts. You should claim against him for being an idiot and running over your foot, and he should claim against you for being an idiot and standing in the road. Then everyone gets to claim! :p
 
Report it to the police, iirc all accidents involving vehicles resulting in injuries should be reported.

As for it being his fault for standing in the road, it's up to the driver to ensure it's safe, given that by the sounds of it multiple people had to take avoiding action i'd hazard a guess the driver is a prat who needs his eyes tested at the least.
 
Yes he should've looked more carefully and definitely should've been a lot more helpful.

BUT

You were standing in the road, therefore you are at equal fault for the accident, hence any claim for compensation isn't very fair on the driver. Just because other people were also on the road doesn't make it the drivers fault.
 
W T F? I had my foot runover by my dads beast of a Lotus Carlton and it resulted in no injury! My advice drink more milk

My younger sister when she was about 11 had her foot (might have just been her toes though) run over by my uncle in an SUV and had literally nothing there too. Might have been the direction and speed it was run over though. :)
 
So you were ****** up and standing in the road, then you got run over? Unless the guy driving was drunk as well then you wont be able to claim anything.
 
You were standing in the road, fair enough the driver could have probably taken a bit more care to look around him, however you were standing where you shouldn't, therefore its your fault. IMO you've got nothing to claim for.

Although it was a bit off of him to take you halfway to the hospital and tell you to walk the rest of the way.
