Right. If you are done for anything up to totting up 6 points within two years of passing your test under the New Drivers Act you lose your licence etc etc

A friend of my girlfriend has been done for no insurance with a provisional while out on a 'lesson'. The passenger did have full licence for long enough etc. The provisional driver is now charged and will be heading to court soon, to get I presume 6-9 points.

Now when he comes to eventually pass his test, will he lose his licence immediately? He seems to think otherwise after looking into it, which to me would be unfair to those with licenses revoked under the NDA after passing the practical.

Who here has got the wrong end of the stick?

Please someone enlighten me. :)
 
The provisional licence will be endorsed, but I'm very interested to hear if anyone knows about the retake situation for this!

Remember, under the new drivers act when you get more than six points you don't get a ban, you just have to take your test again
 
Ok if thats the case, however that just (imo) seems more harsh both practically and fiscally on someone who has passed.. who will then have to pay for both tests again and licence along with the IN30 conviction to declare to insurers etc having already paid for those.

He gets points and fine, pays for his test and gets his licence with IN30?

outrageous in my mind if thats the case.

"When you get 6 or more" not "more than 6"
 
You are allowed up to 12 points on a provisional license. If he passes his test then he will have a full license with up to 9 points (could be as high as 11 in theory). Because the points were gained before passing the test (which is when the new drivers act comes into effect) they do not count toward it unless he then gained more points. So basically gaining even one more point in the 2 years after passing his test would result in his license being revoked.

Good look on him getting insurance with that on his license though (if he does then it will be bend over with no lube..).

That makes sense. The law is an ass.
 
a month after i passed my test i got done for no insurance and got 6 points which put me back to a provisional but less then 2 months before that my mate go done for no insurance but as he wasnt holding his full license 3 weeks later he took his test and passed meaning i had to retake my test again. We had the points for 3 years i think. when i was 19 i was insuring a 1.1 mk 3 fiesta worth maybe £200 for £1100 third party.

I might have some sympathy if you weren't driving round without insurance.
 
im not asking for sympathy. it was years ago now and iv paid the price for it. just glad i never had a accident and now i never drive a car without.
