Bus lane fine..unbelievable

It seems he comes under Haringey Council and can request a viewing of the video in showing him going into the bus lane. Hopefully this would be enough to get them to throw it out.

I don't see "Making space for an emergency vehicle" listed as grounds for appeal.

Councils can at their discretion waive tickets if there are mitigating circumstances but experience has shown they generally dismiss all representations until an appeal to the independent adjudicator is made.

New regulations coming into effect this month create a specific channel where the adjudicator can refer a ticket back to the council if there are mitigating circumstances. The council is however under no obligation to follow the adjudicator's recommendation..

I had to run a red light the other day to let an ambulance through. I must admit I did think twice - what if there had been a camera? Fortunately there wasn't.

It's really sad that we can't have complete confidence in our judicial system.
 
Yeah appeal it definitely, mate of mine did a similar thing and got let off - once they look at the evidence they're generally pretty good about it as far as I can tell, especially in London if you're not a repeat offender then seems like they let you off anyway.
 
One mustn't forget the fact that we now live in a Country that hands out speeding fines to paramedics rushing (legally I might add) to transport an organ for transplant.

Mate of mine told me earlier that he got a bus lane fine for.. get this.. letting an ambulance pass, he had to dip into the EMPTY lane for a mere 4 seconds roughly, they are not willing to work with him (not sure which council, near Bounds Green though) even though the ambulance is also in the picture. Sad state this is.

i must admit im alittle worried about my issue too.

A406, 50mph zone, cameras everywhere. Im crusing past some people in lane 2 by doing like 50mph (they was doing like 45mph). However now along way back in my mirrors i see a BMW Police car closing at a HELL of a rate, However no one else in lane 2 has spotted him it seems. I put my foot down, go past the group of cars and clear lane 3 just as the police car shoots past.

But then i had to slam on brakes as there was a camera there. Im not sure if it flashed the Police car, or me and the Police car together... :(

Thing is slamming my brakes on is also bad as i was cutting infront of a queue of cars. This is why i dont like speed cameras, they are so Black and White, fine or no fine, where as the copper knew what was going on.... None of the ****s in lane 2 was moving to lane 1, and the copper cant undertake at that sort of speed :mad:

I will move out of the way if i can do so legally but i will not go past lines or run a red to let an ambulance or a cop car out anymore. In manchester there are cams on just about anything with a pole over 6ft tall and im not getting points and a fine for letting one though. They may beep and gesticulate at you not moving but will they pay the fine and the increase in your premium? no didnt think so...

I didn't say it did. If he is planning on appeal, I provided a link to assist. It says he can view the camera footage if he thinks the ticket is unfair. So he can request it and then refer to the video evidence when he appeals.

He needs to go through that process and if the council then refuses, he has to go to the Parking and Traffic Appeals Service. However he cannot go directly to them, so regardless of whether they list the issue or not, he still has to go through that route.

At the end of the day according to the law, he is in the wrong. However, he has every right to appeal and if discretion and common sense is used, he should have his fine quashed. Unfortunately, common sense isn't often used when parking/motoring offences are concerned.

Absolutely, I didn't mean to imply he should not appeal. I think he should take it as far as possible and viewing the video is the first step.

I was trying to highlight that councils have no obligation to be lenient or fair when dealing with traffic violations. Quite the opposite in fact, they are incentivised to collect on as many tickets as possible regardless of merit.
 
Thanks, he is going to fight it, i had to egg him on a bit cause he was'nt as bothered about it as its not an endorsable offence but i told him its on principle and hopefully sorting it out without monetry loss, getting ripped off left right and centre with councils and traffic/vehicular stuff, time to fight back.
 
remember if it was a picture, it might have been automated will little human interventaion. if he says he was getting out of the way of an ambulance to a person, it should get sorted.

remember most of these fines run on automated systems.
 
Thats ridiculous IMO, ah well, ill never do that to let soemone past then.

Are emergencyt vehicles not allowed to use the bus lanes anyways?
 
Ridiculous scenario - I would definitely take it to court. Emergency vehicles have flashing lights, loud sirens and a "pass" in the eyes of most traffic law because conforming to it takes seconds, and it can be seconds that saves a life. While an ordinary driver does not have the same, virtually automatic pass, making such a minute infringement that had no negative consequences will be accepted by a judge.
 
Forgot this thread, saw him last week and he said it was dismissed! Restores a little faith that at least some common sense remains in this country :)
