From a purely sporting point of view, no he shouldn't be. However it's the precedent that's the problem.

At the end of the day someone needs to look at whether the flag remained out too long.

I don't quite get the panic about the 1.39 maximum time. It's not for a full lap, there's about 15 seconds of the pit straight that isn't counted in that time.
