The problem is though, I personally don't feel that police officer is doing anything wrong, as a person. While in the role of police officer I agree it's definately not right to be making assumptions about legislation that is non-existent. However, you have to wonder, if you were a member of the public wandering down the street and you saw someone filming you from the bushes (as he was!), what would you do?
Police officers are well within their rights, as is anyone, to ask someone politely to stop filming/taking photos of them etc. It is then at the photographer's descretion as to whether they stop at this point; and in all honestly I think the decent thing would indeed be to stop. However, when you get people like this going out deliberately to harass officers and put them in a position where the line between right and wrong is somewhat shady, you are asking for trouble. The law definately needs to reinforced, but the guy with the video camera is certainly not going about it the right way.
