Girlfriend held for suspected robbery

She attempted to take a top back to Newlook which she had no receipt for, the security guard instantly pinned her up about it.

She explained the situation about a top that had a hole in but couldn't remember the shop she bought it from or when.

He searched back on the system a month, she asked him to go back a little further he refused and took her into the back and called the police.

At this point she was in tears and had been held for 2 hours, un-allowed to use her phone to tell work her situation (30 minute dinner).

Police arrived confronted her about the situation and eventually listened to her side of the story, the officer forced them to search the system an extra month and bingo they found it.

Officer: "Your lucky i'm in a good mood, i would have banged you up for the night if i didn't get back of holiday yestaday."

I mean WTF? 3 hours of work she missed and has been in tears all afternoon, total ****in outrage.

Did she get the officer's badge? She should make a formal complaint to the store at the least

Also a big chain shop like that write a letter to the complaints office demanding action. They will do something about it.

Um, I'm no solicitor (or copper) but the rules on arrestable offences have changed even for police officers never mind Joe Public. A security guard is a member of the public, period. They can't just hold you against your will like that - they have to either let you go or perform a full citizen's arrest (not possible for this kind of offence nowadays).

The girl should file charges for unlawful imprisonment / kidnap imho. Even in the old days you had that option open if a guard placed you under citizen's arrest and you turned out innocent. Advice used to be, if stopped (wrongly!) by a guard in a shop to tell them you've done nothing wrong so leave you alone or perform a citizen's arrest so you can sue their behind for unlawful imprisonment.

EDIT - you guys reply fast lol Complaint to management? LOL I'd be seeing them in court if that happened to me :x

Basically security Guard on power trip and wanted to hold someone and Police officer in a bad mood becuase hes not on holiday any more.
I would complain to both of them, especially the police officer for being a right **** and taking the security officers side.

Yes, but the OP says it was the guard who held her against her will not the police. When the police arrived they forced the shop to look further back and found the purchase on their system.

I read it as he would have arrested the security guard if he hadn't been in such a good mood.

It might be worth taking her down the cop shop and asking what your rights are and if you can put a complaint in.

Contact the police station, either by phone or walk-in. Ask to log a formal complaint, but do *not* get angry about it to the officer at the desk/on the phone.

Yeah thanks for all the replies, the problem is she's a sweet girl who takes this sort of thing to heart, she wont stamp her feet or walk off. Does as she's told.

Aye she will be complaining about this, mainly for loss of earnings.
