Girlfriend held for suspected robbery

See a solicitor about this mate, period. Ignore the calls of "compensation culture". The fact is this store allowed a member of the public in a white shirt to basically kidnap your girlfriend and falsely imprison her. I would NOT be taking that lying down.

She didn't trip over a bit of pavement and shout whiplash, she was held against her will for the afternoon FFS! Seriously, take this further. The guy probably got bullied at school or something :D

Perhaps because this is a legitimate case.
Or perhaps we should be more concerned with ensuring the officer and security guard in question get disciplined for upsetting and wasting 3 hours time of an otherwise innocent person? Nah, £20's worth of vouchers, far more important.

Dont you have to actually leave, or try to leave, the shop with the item before they can collar you for attempted theft? Otherwise how the hell do they know you arent bringing something back for a refund anyway ( just because its in a bag ).

Id be making a formal complaint to the store and seek advice concerning the apparently illegal actions of the "guard" in holding your gf hostage. If he wanted to press charges he should have gotten the police to come straight way and arrest her. You cant just hold someone for 2 hours because your security guard is a retard!

They probably thought she was bringing back a stolen item for a fraudulent refund.

Maybe but how the hell could they ever prove thats what it is anyway? i mean how could you PROVE it was stolen in the first place

What people have said about the security guard being a no-body is true however. Hes not a police officer and has no powers above and beyond you and me and anyone else on the street. Just because he thinks it may be stolen does not mean he can confine her for 3 hours against her will. Thats usually called kidnapping under normal circumstances.

I can see the shops side of things but surely they cant just go around locking people in rooms because they "think" things that they have no evidence for. As a side note was a female member of staff present at ALL times during the 3 hours? if not then thats opening them up to all sorts of sexual harrasment and sexual assault accusations. I mean if my gf was hold against her will by a man with no female staff members present id be in the store NOW demanding to see the head honcho and kicking off big style about just what the hell they think they are doing! i mean the poor girl could have been terrified she was gonna be raped or something by this gorilla in a uniform in a back room ( silly i know but stranger things have happened ).

yeah and the best way to force discipline is to get the company fined a few grand, will probbably fire the guard, if they just complain the worse that will happen is he will be told not to do it again.

Where did I say that?

I said go to the cop shop and complain to the complaints department. if you have no luck with police the store should do an internal investigation. If you don't accept a brush of with the first letter.

Oh dear, I think someone will get fired over this.

1). They had no right to prevent her from using her phone.

2). They are not allowed to hold her without a concrete reason/evidence.

3). The officer was out of order and it should be easy to track down who it was, as they were called.

I am against compensation for silly things, but this is a rights issue. Get a no win, no fee solicitor asap. This is probably an easy win, also see what your solicitor says about going to the press on it. If it is a nationwide store, the main tabloids will love it.

Right at the point where you quoted da_mic_randomnumbers.

No, just NO

I merely said he should get way more than £20. Nothing more nothing less. That was it.
Which is true. In a situation like this she should get loss of earnings + some other stuff. On top of any legal action and any internal investigation.

A formal complaint to the police will more than likely get the security guard fired, and the police officer will be dealt with more sternly than just "told off." They have formal disciplinary proceedings which are followed when you register your complaint(s). They are handled by "internal affairs" (proper name I forget) and they handle these matters by the book. The police investigation will probably involve discussion with the shop (or HQ if they are a chain) and everyone should know by now that retailers throw away staff for even the smallest of incidents.

a) If she lost earnings. b) Yes, you agreed to £20 vouchers, then went on to claim she would get more if she is to "disagree with the first few letters"

hen went on to claim she would get more if she is to "disagree with the first few letters"

yes as the first few letters will just offer compo, he needs to demand an investigation.

you really have taken it without reading the other posts and jumped on the totally wrong end of the stick.

'Compo' still makes me laugh, I said it to my mum with a straight face the other week and she proceded to call it compo for the rest of the conversation without a second thought. :D

Oh dear :( The replies in this thread show why britain is in the state its in and why chavs have such free rein.

How come people here always go on about police not doing anything one minute then when they try to do a job they get complained about again. Its not as if she was beaten over the head or actually imprisoned. Good god!! Yes she was held for a few hours but does it really warrant having to try to sue the company, make formal complaints, etc, etc. If she was hurt or held overnight then fair enough but she wasnt!

Chavs get away with so much nowadays thanks to everyone being scared to get involved or try to stop them. Its people like those that have replied "Sue them" etc that have caused the problem in the first place...
