That seems confusing, why would the officer say something like that after proving that she was innocent?
 
Um, I'm no solicitor (or copper) but the rules on arrestable offences have changed even for police officers never mind Joe Public. A security guard is a member of the public, period. They can't just hold you against your will like that - they have to either let you go or perform a full citizen's arrest (not possible for this kind of offence nowadays).

Security Guards have the same powers as a PCSO and can hold a person or persons until the police arrive to take charge of the situation, No Citizen's arrest is necessary as they DO NOT exist any longer as it was deemed unsafe for the public by government.

The girl should file charges for unlawful imprisonment / kidnap imho. Even in the old days you had that option open if a guard placed you under citizen's arrest and you turned out innocent. Advice used to be, if stopped (wrongly!) by a guard in a shop to tell them you've done nothing wrong so leave you alone or perform a citizen's arrest so you can sue their behind for unlawful imprisonment.

Haveing been a security guard and Police special constable i know that if what happened is exactly as has been said then you can make a complaint but i doubt much will come from it.

2-3 hours held and refusing to check the system to see if she is innocent does not ream like a good reason, nor a reasonable amount of time, also refusing to let her contact the police/work/lawyer/family etc seams very dodgy ground.
 
They probably thought she was bringing back a stolen item for a fraudulent refund.

Happens all the time at our store. Probably even worse at New Look, being a 'cheaper' store.

Why did she wait a couple of months before taking it back? This bugs me. Women damage their clothes, then decide to take them back for an exchange. You're given 28 days to return any goods.

Had a women just today: "Hi, can I bring my denims back, I washed them once and they shrunk.....must be a manufacturing fault." Yeah, so everyone else is walking around with shrunken jeans. Idiot. We ended up having to exchange them for a new pair!

Anyway, that's still a shame about your other half......she shouldn't have been treated that way, no matter what the situation.

If a citizen's arrest no longer exists then what specific law or statute gives a store security guard the power to legally detain another person?
 
A similar thing happened to my father in the local shopping centre only he wasn't held against his will:ex aba heavyweight boxing champion.
Thing is he had just parked his car up on the shopping centre car-park and was cutting through. He was carrying a suit that needed dry-cleaning which was fully wrapped up.

I won't go into the exact details but three security guards were nearly beaten up as they attempted to man-handle him and the police that were standing at the shopping centre entrance with their battons out were left red faced by the time the incident was cleared up. Two of the security guards were sacked due to the mushandling of the situation and for getting the police involved. The head of security indicated that all of the guards involved in this had to do was ask my dad about the suit for a simple explanation. I beleive this goes on quite often. Potteries shopping centre this was.
 
sorry, havn't read the whole thread, but you could go to the local paper and see if they want to name and shame. Feel really sorry for your gf, I see guilty folk getting away with dispicable things, and the innocent just getting a hard time

The Dail Mail and Express are quite good for this. Innocent girl held by security guard against her will etc. Don't know how much they pay? :D
 
From the sounds of it the only thing wrong here is that your gf appeared so guilty that the security guard didn't see the point of checking all sales beyond the reasonable time period. I'm sure every shop lifter he catches claims they paid for it before etc so he's heard it all before.

She was held until the proper authorities arrived. Once they did they insured a proper investigation was carried out and her story properly checked. The officer found evidence backing up her story so released her! From what you've said this is exactly what happened and exactly what should have happened!!!

security guards...........don't even get me started. I work in a mall and the security are hated by pretty much every person who works there. The Fed-Ex and UPS drivers are at the point of open war with them. I hate to generalize....but trumped-up police wanna-be's with more teeth than brain cells :mad: Ours even get their own police look-a-like patrol cars they can circle the mall with - all they do is cruise around telling little old ladies they've parked 0.23765 inches too close to a fire lane.

so its ok for a security guard to do this with no proof ?

if i was to go to tescos tommorow can i expect to be manhandled and held against my will if i am carrying a loaf of bread bought earlier that day and a security guard has a hunch that i stole? without any proof or witnessing me stealing or acting suspiciously?

Nonsense.

Are you saying you would be happy if this happened to you or a loved one? I would be absolutely livid personally. Or would you prefer to live in a world where people can be held for hours against their will by idiots in uniforms with no real legal power or training?

I would have to agree with you completely on this point being held for longer that 30 mins before the police arrived. The Shop manager / assistant manager should be the one to sort this out from the start and nothing to do with the guard, but too many of them are power mad and think a uniform and radio make them god!

Without proof the guard can do nothing! that is the LAW 99% of the time you have to have seen either on cctv or with your own eyes the person pick up the item and walk out the door with it without loosing sight of the person for the entire time they are in the store.
