Ok I'm bored of it now. I even got my books out covering the issue to prove my point. Anyway, consider it over.

Im not disputing your information provided from books or sources. Im merely stating that your interpretation of this information is wrong. What you are trying to say is that anyone who is drinking who owns a car is commiting an offence, whereas im saying that without the possibility AND the intent (however small) of driving, it is not an offence.
 
Why would you even create a thread about this? What possible responces were you hoping to get ?

because if i just bought the car but aint payed i would be test driving it and covered on their insurance. im not sure how it works tbh but thats what i was told.

Ok, the problems with this statement:

Bought a car but havent paid? how does that work? Who 'owned' the car at this time?

Test driving it under trade insurance without trade plates, again, how does that work?

Not wanted to start it up again but I can't help but reply.

In one of the first posts in this little discussion I did say:

"However, for a prosecution to be successful under this section, there must be a likelihood of this person actually driving the vehicle whilst they are over the limit"

Doesn't mean it's not an offence, it just means it will never be prosecuted.

Legal system in very short = Offence -> arrest -> charge -> prosecution -> conviction

This incident would never go past the first ->

So what the hell is an 'unprossecutable offence' other than not an offence?
 
I guess we have a different opinion around the technicalities of the wording and what we know to be an 'offence'. I can only say what I know from a legal point of view.

And I do agree with you when you take the litteral and legal wording view. What I am saying is that in the real world common sence enters the equasion and the 'offence' is not standing without any of the ground on which i can be procssecuted.

Surely innocent untill proven guilty fall into this too. If it cannot be prossecuted then you cannot be proved guilty and therefore must be innocent? Actually, im probubly taking it too far there.

Basically, your view, literal, all drinking over the limit whilst owning a car is illegal. My view, real world, without intent or any grounds for any prossecution then there is no offence.

In fact lets go ask the courts to find out the parliamentary intention behind the act. That would sort the argument out! ;)

To the OP: One issue which hasn't been raised (i don't think) Is how the police caught you. You must have done something to attract their attention? :confused:

I reckon I could drink drive all year without insurance and as long as i didn't crash or drive like a numpty, never get caught (not that i would have course)
 
Should be a life ban tbh. From your previous posts you sound kind of dim.. i'm scared to drive knowing people like you are out there.
