Well actually, you aren't meant to eat or drink anything whilst driving.
No of course it isn't illegal, you always see those drunken people taken into a taxi or something on TV to be taken back home.
But there could be an argument about the people drinking may cause a 'distraction'.

It is perfectly legal for passengers to drink alcohol in a private car at any time.
It is illegal for passengers to take alcohol on to, or drink alcohol on any vehicle with 8 or more seats or a train travelling to a football match though.
I also said that there is an argument that if people are DRINKING it could be classed as a distraction or something...as has been said about 4 times, i wasn't asking about taking drunk people but people who are actually DRINKING in the car. IE. beer to mouth whilst vehicle is in transit.

Does it really matter? At the end of the day, people don't drink in my car, which is a good thing (in my view), so that's what matters.

No, it doesn't really matter but if it was me I'd rather not have a mate look up the rules regarding drinking in cars because I told him it was illegal. I'd just rather be straight with them, that's all. But as you say, it's no matter.
It's perfectly legal. You don't have to be sober to be a passenger, wtf is wrong with you lot? You can be as ****** as you want in a car, as long as you don't have the keys.
Isnt that due to the fact that you dont have 2 free hands, in the same way a mobile can be used via handsfree, what about one of those beer can caps with straws![]()

....However, it can be at the Police's disgression if a passenger is so drunk as to be a distraction to a driver, and be dangerous...
