some advise please.

im currently renting a flat with a parking space allocated for us.

our parking space backs on to the rear of a cafe which has a reasonably largish tree overhanging from there property above my car.

needless to say this tree seems very popular with the birds who seem to take great plesure in carpet bombing our car with bird mess. everyday we go out to our car and it is usually covered in the stuff. we have asked the landlord and the shop owner if there is anything they can do, who both say no.

as a result i am using another space but concerned of any potential agro with our landlord.

do i have any rights?
 
lol. maybe a bit extreme.

could i take argue that i am using another space because of the situation?

or would it be possible for me to prune the tree back so it doesnt hang over my car?

snakedoctor. i have considered doing this or putting a plastic owl in the tree etc. think it would work?

Depending on the birds, you might be able to shoot them legally.

But, isn't it easy to find a bit of tarpaulin

pidgeons with the runs it seems!

thats the other idea. i was thinking about buying one of those covers.

do u think its a case of put up and shut up? i just think its a bit off being forced to park in a space where my car is gona get messed up,
 
If the tree overhangs the property of the landlord, he can cut it back (must give (or offer to) the cuttings back to the owner though).

to be honest the guys in the cafe are utter **** holes. my gf ha already has a run in with them because they have blocked us in from the other space we use. ( they feel it is there space, even tho there is no signage) and as a result of one of them parking to close, my car already has some marks where a door has been opened into it.

i would take great delight in chopping the tree back and just dumping it in there back yard.
 
You could seek legal advice, or to get it over and done with get land lords permission and pay for the chopping yourself
 
Mr Fox is correct, as far as I can tell given the information you have no rights here. You pay for a parking space with the flat, you don't pay for one without defacating avian life sitting over it. You've got said parking space, unfortunately you also have birds pooing all over your car but while inconvenient it is hardly as if you are being denied legitimate and peaceful use of the space, you simply need to clean your car more often is one possible answer.

//edit, common sense of course suggests that if no-one objects to you using another space then that is the simplest solution but I don't know whether it is or isn't a problem for you yet.

dont you feel every day is a little excessive? i really mean it when i say carpet bombed aswell. lol

as said in my above post my gf has had a run in with the owner (turkish guys). who seem to think they can park wherever they like and even damage my car. i looked into an insurance claim but unless i have a admission i cant take any action

You are essentially dealing with two separate but somewhat linked issues: a) would anyone be happy with having to clean their car everyday because of bird poo? b) what is the legal situation and your rights?

The answers are a) not in the slightest, it does seem excessive but there are possibly ways round this (car cover, parking in a different space etc) and then b) you've got no real legal rights in the situation that I am aware of, the landlord is due you a parking space that you've paid for - this has been provided. If you can prove that your car will be permanantly damaged by the bird poo and that the landlord or owner of the tree owes you a duty of care then you might just have a case but frankly I'd expect it to be laughed out of court when there are other solutions without resorting to the legal system.

//edit as for damaging your car, that is different but you would need some way to prove how it happened and who caused it. It doesn't necessarily have to be an admission of guilt from them but you would need some other form of evidence in the absence of an admission.
