Legal Advice Needed Please

I wouldn't accept half the money! You were guaranteed that the cambelt was done and with this information in mind, you proceeded to buy said car. If they had told you it hadn't been done, you probably would have walked away from the deal.

Push them for the whole amount as they've even admitted they've mislead you.

i would want it changed and all paid for bye them they have mislead you and thats not on.

get water pump done at same time ( which you will have to pay for ofcause plus about 1/2 labour) when doing the cambelt!

I didn't really push them for the full amount. I will get my dad to speak to them and hope he can push them to pay for all the work. If that fails, then atleast I've have the offer of half the price on the table.

We'll contact them tomorrow, so should give an update tomorrow.

Does the waterpump need going soon?

What are the intervals for replacing the cambelt? If the interval is 30,000 miles and you'd done 10,000 for example then I'd expect them to pay the full amount, less a 33% deduction.

It's 60,000 for the cambelt, so it was or is due now.

I am 19, bought the car when I was 17. That's why I'd rather my dad speak to them.

Why any deduction?

That's like saying if he had done 1000 miles short of the interval then the dealer should be absolved of any responsibility for lying in the first place.

Because if the dealer pays for it in full now, you're 10,000 miles worth of cambelt usage better off.

It won't affect future resale at all. A cambelt either snaps or it doesn't.

If it was replaced free of charge now the car would be worth MORE as it was 60,000 away from the cambelt needing doing, rather than 50,000 miles away.

Bottom line (IMO) - he was lied to at the time and at the time the dealer owed him a car with a cambelt change or the cost of that cambelt change. I certainly wouldn't accept anything less.

Depends how much time he wants to spend trying to claim it back, if it came to weeks of exchanging letters, and phone calls to the garage and any legal advice - I'm not sure that would be worth £175 of my time. I think I'd just rather it was done as soon as possible and get it out of the way.

It is unlikely the garage who sold it actually meant to mislead - the consequences of a snapped cambelt shortly after sale would not be worth their while. Possibly the previous owner has told them this, mistaking the aux belt for example. Most people are 'tards as far as cars go and wouldn't know one from the other.

In my opinion, the garage are rather kindly offering to cover their good faith error. If it had been 3-6 months down the line, the full price should have been covered without question. This is more than 2 years ago, you are fairly lucky that they are offering to pay anything at all.

Er, not really - they didn't tell the truth about it, its their problem. Sure, its a positive thing that they're not saying "so sue us", but when something like that occurs they should cover the full difference.
