Ebay, paypal dispute (Item Not As Described) "Apparently"

Nice lie. No unboxed 8800gtx was sold on ebay for £135 inc or exc delivery in the past 2 weeks.

The closest item was one at £136 with a zalman waterblock.

Only 22 8800gtx cards have sold since 25th september.

Anyway, case in point, the guy used a way of searching that I'm not aware of; apparently he found your card from the description of the listing, not the title or body text, and the search he apparently used was for “new”. Now, in order for your card to be “new”, it has to be unused:

I used it for around 2 weeks before i upgraded to a 4970 and it worked perfect like a charm.

So that’s new off of the list then – are you starting to see his point?

Yeh i am seeing the point, technicalities though scort. An item which hasnt been used is basically new? like when you test drive a car from the showroom, its been driven. Do they knock off 25% and claim its been used? no.
 
Sounding silly cause i want to collect my card and not pay 10 quid? i probably made a slight mistake but still doesnt change fact it is still basically a new card. and i would appreciate not being branded a liar on an internet forum after providing paste of messages, thats just as silly so please dont be a hypocrite.

But its not new is it. You stated in your original post that you had used it for a few weeks, then later claim that you literally just "tested" it.

True he should have read the full description but conversely you listed it under a new item listing when its clearly not brand new, by your own admission its been used.

Clearly you have your own definition of "new" that is somewhat at odds to what other people would consider as "new".

I think it might be a good idea if you dont use Ebay again. It's very easy to use but it seems to be a bit above you.

Hint: If you have used an item, it is no longer new.
 
Yep, ill wait for him to escalate, i havn't exactly recieved much help here aside bashing which is pretty pathetic to be quite honest, i only asked for a few positive opinions as to which what is going to happen now if it is escalated.

You wanted us to back you up on something - but are annoyed we don't agree with you?

I think you just got caught out and are now trying to backpedal - everyone here is right it is a used card, it is not new - new is sealed, not tested for a few weeks.

Technicalities they may be, but it’s these technicalities that will probably be your undoing, if eBay or PP bothers to help, thus you ‘lose’.

If something is hardly used and in great condition, then it is “like new” (notice the key word there), now, from my limited used of eBay I only recall seeing options for new or used – your card firmly falls in the latter, that’s just logical. You can then use the body of your listing to tell people how great the condition is etc.

A bit above me, granted aswell coming from someone also quite largely misinformed this has been happening a lot recently, ebay has fallen a bit from grace. I advise you to do some googling or it seems it may be a bit above you too.
 
You miss-led him and you know it, take it back, refund it and relist it properly and honestly.

You expect decent feedback when you ignore vital things people look for when buying, imo that's ridiculous (especially when it says "new" at the top). People always like to buy things with the retail box, etc.

What are you talking about? My search was limited to the past 2 weeks. That card didnt show up because of that. Thats the fleabay default setting as well. I didnt look beyond that because he said his friend sold it last week.
