Ebay, paypal dispute (Item Not As Described) "Apparently"

I think you just got caught out and are now trying to backpedal - everyone here is right it is a used card, it is not new - new is sealed, not tested for a few weeks.

No, i dont expect people to back me up, most have been constructive and honest. But most posts have just been written as an attempt to bash me which i feel is very pathetic.
 
A bit above me, granted aswell coming from someone also quite largely misinformed this has been happening a lot recently, ebay has fallen a bit from grace. I advise you to do some googling or it seems it may be a bit above you too.

Yep, ill wait for him to escalate, i havn't exactly recieved much help here aside bashing which is pretty pathetic to be quite honest, i only asked for a few positive opinions as to which what is going to happen now if it is escalated.

I wouldn’t say you’ve been given a bashing, if anything people have tried to help you see that something used is not new, but as AtreuS put it, you seem to have your own definition of “new”.

You miss-led him and you know it, take it back, refund it and relist it properly and honestly.

I mislead him and i know it? example of unconstructive tripe congratulations and doing nothing useful aside bashing again. I didn't aim to sell card on as completely new, i made a mistake it seems otherwise it would have been sealed. But i stated that clearly.

Well, actually no, hence why my responses have been pretty composed instead of a lack of ability to formulate a constructive post in "anger". Least by going to bed i'd be doing something more useful than yourself.

Along with watching paint dry.... something still extremely more useful than you.
 
So you think it's ok to put something up as "new", then say: INCLUDES EVERYTHING IN PIC instead of saying "used, nearly new, includes everything but retail box"?

You'd be pretty annoyed if you fell for a trick like that I bet.

To be honest the buyer should have been more sensible. I'd never part with a £1 without reading any listing carefully. To part with over £100 makes me doubtful. I'm wondering whether he has deliberately exploited it. Unfortunately the law I have learned is in business and doesn't cover private sales, but i think common sense says that a mis-sale is just that and despite the buyer being dumb doesn't change that story. I imagine though listing it as new when it is used breaches ebays rules anyway and therefore the man has a right to a full refund.

You can either wait and then if it goes further act then or just acknowledge you were wrong and ask for it back and refund him.

Thanks for a decent reply, well as i said if he had said to me and asked for a full refund rather than a partial one essentially selling the card for nothing i may have been more sympathetic. Which is why it led me to believe he's maybe thinking ill make a real quick deal.

He himself in the paypal dispute claimed he didn't even read the item description. So yes hes in wrong but then again so am i guess listing it as new. But i tried to be as detailed and truthful as possible and provided a bunch of close up pictures.
 
I think twisting your face over a marginal amount of money, when quite clearly you misinformed someone/forgot to get everything accurate is a bit cheeky.

Sorry dude, but if the item says new in one thing, then its perfectly possible the guy got mixed up from your own wrongdoing

Ok, fair enough, the buyer did still bid and win, possibly without reading the body of your listing, but it doesn't change the fact that your listing was misleading and as such, you are unlikely to get any backing from eBay, PP or OcUK’s forums.

I guess in which case ive been saying all along ill fully refund him, yet everyone has failed to even note that point and i am apparently dishonest...if i was dishonest id close my paypal acc and tell him to beat it and not reply to him.

Whats to say the guy didnt search for "New" condition in an advanced search on ebay and then just bought it thinking it was new. Yes he was stupid but then again so were you for listing it as new when thats something people can search by.

Why not offer to refund say 10% and be done with it?

Finally constructive from you, yes i agree he may have done that, still angers me every other bidder probably read the description and was like fair enough. He also claimed it has no warranty? if he had half a brain he would know BFG is a lifetime and i provided him with a link to it. I just rest my case i made a mistake ok yes. But the buyer is also a total moron and thats why im so reluctant to deal with him amicably as i feel hes trying to fleace me.
 
Tell him you sent it free of charge (it costed you £8) and you'll take off £20 or something. Hopefully he'll accept it. I'd suggest at this stage you cut your losses. You don't want to get on to the wrong side of paypal and that. He'll probably give you bad feedback anyway whatever happens.

Ok, I do agree with this to a point, the person buying should have paid more attention; what with the amount of scams that have happened on eBay – but (and that’s a big but), it doesn’t change the fact that the listing was misleading. Who knows, maybe the guy runs a computer business, ran a search for new kit and bids on the lowest price stuff, then lets it run it's course without checking back?

As you say the buyer could have deliberately exploited this sale, it’s something that crossed my mind initially, as for sales like this it is usually caveat emptor or buyer beware, but going back to the misleading sale – who knows.
