Insurance... what do I do

So my car is parked up at work (on work property)

and I notice out of the office window that a car is reversing rather close to my car... then it decides to not stop and scrape my bumper rather nicely!

so I go out and get the details from the woman, she says she would probably prefer to sort it outside insurance... having got an estimate of £375 for the repairs I doubt she will settle outside of insurance any more...

Amazingly I have the footage of the incident on camera (thanks work!)

Just wanted to ask for some advice and an idea of where I stand?

in that case get in contact with her, if she dont wanna play ball and pay the repairs go through insurance, its her fault after all and you have valid visual proof.

Does anyone know of any issues regarding the fact that I was parked on "private land"
 
what do you mean? It's still an accident and her fault and you have video proof.

I can't see that £375 is worth going to her insurers for as the increase in premiums is likely to be that over the next few years...

well she was driving a 57 plate Yaris T2... which is group 1 :eek: so im not sure and she was like 35-40
 
what would make you think that £375 would make a difference ?

doubt she was expecting much less

It just seems a lot for the damage... and she has mentioned to me that she has a friend that does "that kind of stuff" (spraying etc)

She said she will talk to him tomorrow and ring me back, I made it clear I would like to go with a garage I have used before... and if not I am willing to go through insurance.... was that the right decision?

Yes, you are not obliged to do anything by her terms nevermind use her 'mate'.
 
As long as there is an entry/exit to the "Public Highway" you've got no worries.
It is the same with a supermarket car park - people used to think you could go and practice your driving in car parks when in fact they have the same rules and regulations as the open road.
 
Thats great, now lets say theoretically if I had an undeclared mod on my car...

would an inspector come and look at my car even though I am claiming off her insurance?
 
Your cars insurance status is not relevent and this incident has nothing to do with your insurer beyond you notifying them it happened.

So what your saying is that even if I "slapped a 2litre red top under da hood" and didnt tell my insurance company..... I should be fine? :D

I am starting to get the feeling she wasnt insured... just that she hasnt got back to me yet and she bought the car a day before the accident.... and it was a cheap to insure car so Id imagine claiming would be cheaper...

From a technical and legal perspective yes, you're right. However, from an everyday standpoint, a lot of people would deem it acceptable. You're also far more likely to get moved on by the police after a few words in a supermarket carpark than you would be if you were stopped under similar circumstances on a standard road.
 
So Im trying to call her and she cuts the phone out on me every time, sends me a text saying her solicitor will be getting in contact with me...

sounds like she wasnt insured :(:(:(:(

an ideas where I stand now?
