I've just been told by my manager that the boss of the restaurant I work for doesn't have enough money to pay all of the employees this month, due to lower than expected takings. Unfortunately I'm one of the employees he can't afford to pay.

I'm just wondering, where do I stand? I'm owed ~£250, not much I know, but rent is due on saturday which will leave me with almost no money to live off for the moment!

Cheers for any advice :)

Sheesh that's tough - most employers you would hope have an employee loan/overdraft facility rather than operating on a cash basis..if of course he isn't just spinning you a story (most likely IMO!)

I would ask how much he is paying himself this month! Do you have a contract?

No contract unfortunately, he only employs the manager & assistant manager on a contract.

I'm tempted to just ask for him to pay me out of his own pocket, it seems silly to rely on takings when they can be so inconsistent!

They cant do this, In fact if they dont pay you i think you are within your rights to force the company into liquidation.

I tell you exactly what you do - tonight you invite 10 of your mates round to your workplace for dinner.

Then when you get the bill, you say you don't have enough money to pay all your debts this week and unfortunately your boss is one of the people you can't pay.

Then you dont work.
He is obliged to pay you in cleared funds at the end of your week in hand regardless of contractif thats what your notice is understood to be.
Go to the CAB, they will tell you what to do next.

Haha, nice! :D

Hahah that is a very good idea. Ask him if he'd like not to be paid after working his ass off all week?

You need to kick up a stink in all manner of ways, and I love the "get your mates over" idea :D. OP - you can't decide when you do and don't pay employees . Get on it and cause a ruckus.

He's told me it'll be sorted by Friday so I'll wait until then before seeking any alternative action.

Thanks for the advice, I'll keep it in mind :)

Slight turnaround there? Sounds like he's stringing you along and trying to bide his time. If you're due the money now I'd be taking action right now.

This does happen. Liquidity is not always clear cut. But start looking for another job if you can. This type of thing is usually a downward spiral especially at the moment

Start exploring which avenues you need to take IF he stitches you up on Friday.

I.E- Contact CAB now and get some answers, be prepared.

So if he does screw you at the end of the week, you can get medievil on his ass right then and there!

tell him rather than other people getting 100% of their wages whilst you get 0% of yours, you think it would be fairer if everybody received say 75% of their due wages.
p.s. best get your hand in the till quick over the next week :)

Call in a debt collection agency or demand that he give you a notes payable. Ensure the note has interest to suit your needs.

Or you could just sue him for the monies but seems a bit harsh if he is an otherwise nice guy.

Everyone is taking the aggressive approach, if the boss is a reasonable enough bloke, then give him the chance to delay your wage till friday. If he doesnt produce it. then you can hunt for it.

If the bloke does this kinda thing often or seems totally unreasonable then push hard for it, but otherwise dont just jump down his throat straight away, if the fella is struggling with his finances right now hes probably feeling crap enough as it is.
