Hit by an uninsured driver...what are my options?

Great, looks like the driver who hit me on friday after falling asleep in the fast lane and clobbering me in the middle lane may not be insured. Any clues as to what to do from here or any other folks' experiences?

Contact your insurer who will have information for you ref: Uninsured loss bureau.

Thats what happened when i had a similar incedent.

Depends on whether the driver was totally uninsured or driving a car that was insured but just not for him to drive. In the case of the latter, the insurance can pay out for your damage.
 
The car is insured by his dad who is the owner. However he was driving it under the pretence he was covered as he has a policy on his own, different car. The insurance co are saying he isnt covered as his policy isnt updated or something to show he is over 25. I digress.

So I can still claim from the insurer, i.e. his?
 
You can still claim from the insurer.

If the driver is not covered then the insurer still has to deal under the terms of the Road Traffic Act 1988.

Essentially, they are obliged to settle an unsatisfied judgment. In reality however, they are more likely to obtain the driver's consent to deal in order to avoid the expense of litigation.

Either way, your claim will be resolved.

Yup, you can claim. Happened to a mate 18 months back. He got a replacement car through helphire as well, it was amazing how much quicker the 3rd party insurer acted when it became obvious they'd be paying out EVERY DAY they didn't settle.
