but you are taking action against the company, not the individual. The bailiff will have to find goods belonging to the company. If the trading address is also that of a director then the director need only say that everything within the property is his. Going down the bailiff route is fraught with problems at the best of times. You have probably found the worst possible case where you are proceeding against a small, one-man-band, limited company. You and/or the bailiff have to extract the necessary from the limited company and to do that you/the bailiff needs to identify assets of that company.

There are circumstances where the debt could be carried over to the individual, forcing the individual to cough up or otherwise go bankrupt. For example, if it were shown that the company director allowed the company to continue trading whilst insolvent.

yes, but the current action is against the limited company. What you suggest is quite correct but is much further down the line and will require another court case - or three.

You seem to be very willing to point out all these problems but no solutions... any ideas?

Last registered at 22 Woodside Street May 2007.

The company is still active but the accounts are overdue from October 2008.

Looks like Mr Curtis has moved on. No listing under either possible alias.

I think unless you have oodles of cash to spare for a court fight you'll have to chalk this one up to experience.

His business will have no assets (it's obviously been run from his home), the servers will have been leased etc. so there's nothing to claim back - plus it's probably that he owes other creditors money and they would be in the queue before you.

You make valid points but I've already spent the £25 court fee so I've got nothing to lose :p

If I can find a mobile phone number for this Ryan Curtis bloke then hopefully all should be well :)
