Hey All,

Quick question. Have I committed libel in the below sentences:

Them:

I personally wouldn't dream of using the phrase to someone's face

Me:

It seems he wouldn't say it to someone's face but behind their back, that's ok.

Them:

Nope, didn't say that either, and unless you wish to test the libel laws in this country I suggest you delete it.

Me:

blah blah

Although I will correct my punctuation, I wouldn't want that being quoted in court unfinished.

(so i go back to my sentence and replace the fullstop with a question mark, which i actually intended to use, but placed a fullstop)

So the post above from me reads:

Them:

PM. I suggest you take notice.

Their PM:

I'm serious, I suggest you don't test me, it is my area of expertise.

My reply:

what part is libellous?

it has a question mark at the end, therefore its a question and not a statement of fact.

Although i am quite impressed with your bully boy tactics.

Infact if your such an expert can you show me the point of law this refers to?

The original comment (a transcript of which I hold,) did not contain a question mark and was stated as fact. If it is not removed altogether I will begin proceedings. Please consider this your final warning.


I havent yet replied, as i'd probably lose my temper and go into one, however, i am wondering if I have committed libel. A quick search of the net reveals a few stories of chat room libel. :eek:

I want to know, as I have added a ? to the end, does this correct the libel comment and IS IT LIBEL?

I'm trying not to lose face as he is a complete douche, lol.

Pfft. Just ignore him. No chance in hell a court would ever even consider this sort of ridiculous case. Just trying to be alpha, can safely guess its not his area of expertise or that he has any legal knowledge really at all.
 
Which is "this country"? Because that may affect the possibility of it being a libellous statement. Also without the statement in dispute it is nigh on impossible to give anything more than the general point that truth is a defence to charges of libel and you may possibly get away with it being 'fair comment'.
 
I don't think you have stated anything in your post that could be taken as anything more than your opinion

This is the sentence in question:

We were talking about the word "****". I suggested that he would say it behind someone's back but not to their face.

Does he have your real name and address to begin proceedings against you? If not how does he plan to have papers delivered to you?

Also please post a link to the other forum and thread so we view for ourselves.
 
I suppose he'd better start libel against everyone else on a whole bunch of forums who said worse. And news papers. And blogs. Oh dear...

The forum that its on, i think has my name and address and he is quite friendly with them (in order to buy and sell stuff), so they can probably give it to him, although i'm sure that would be a breech of data protection laws.

I'm not really worried, more annoyed that he pm's came across condescending and talking down to me.

The community I ran decided to do that one day, forum raid some innocent forum. I got a letter from the data centre I host at threatening to close the account lol. It's not a good idea!
