Paying rent advice

Me and my GF are about to move to a new place in a couple of weeks (downsizing to save money), but are having slight issues with our current landlord regarding the final rent payment.

At the moment we pay £750 a month on the 5th of every month.
We needed to give a months notice of the termination of the tenancy.
Our 6 month tenancy agreement ran until January 27th.
We notified the agent (and the landlord out of courtesy) on the 6th of January that we wished to move out on the 8th of Febuary.
The landlord has only just got back to us (13 days later) and has stated that we will need to pay for the month in full (£750) instead of paying the amount remaining between the 5th and the 8th. Is this right?

Nowhere in the contract does it state anything like this, and the landlord says that we should be dealing with her, not the agent (but wtf is the agent for then!?). any advice? The GF is going to CAB today to ask them.
 
I'm going to guess that as with a lot of 6 and 12 month agreements the actual term is 7 or 13 months.

Your 6 month agreement runs out on 27th January.
At this point you can give your 4 weeks notice - meaning payment would be expected until 27th February.

Very similar to 12 month mobile phone contracts - you have to give your months notice at the end of your agreement meaning in effect you're on a 13 month contract.

never had that ourselves. your end of contract date is the date you are supposed to be out by (in our experience).
you have to give your notice a month in advance of that date, or the contract becomes a rolling one on a monthly basis.

MK - imo you should not be going over that date unless previously agreed by the agent/landlord.
If you pay the agents, then speak to them, you should only have to pay an amount that is equal to the days that you use, not the full month.

Watch out for your deposit, once the ast runs out the contract is void and becomes what he said rolling.

why?
it should be registered (if you have taken the place in the last few years) with a deposit scheme, the deposit will be safe from the landlord thinking he can take money from it to cover this silly period that he want paying :]

That is wrong. I was recently given the option to move out at the end of my 6 month agreement, as long as I notify them by the 29th January I can move out on the 29th February, which will be exactly 6 months after we moved in.
 
Thanks for the advice guys. I think my problem is that we are wanting to move out after 6months and a few days. It is the few days that is the problem. I know in theory that the few days becomes a rolling contract, but does the rolling contract jump up in months? Surely the tenancy agreement is the bible and the law here? And that doesn't mention much at all.
 
If its over the 6 months then I think they are correct in asking for an extra months rent

I would also check to make sure that a notice isnt being posted to have you removed on the actual date of the end of agreement and new tennents moving in.
Get onto the agents ASAP.

In our experience, the agents have always contacted us 2 months before end of agreement to find out what our plans our, telling us we have to let them know ASAP if we intend to leave or stay.

I would also be wary of the agents asking you to sign a contract renewal for that short period, some crap agencies will charge for it!
 
Well the agent (and landlord for that matter) are rubbish. Never in the office, takes 3-4 weeks to reply to emails and letters etc.

The contract says;

"The tenants shall give one months notice prior to termination of this tenancy"

And doesn't mention anything about rolling contracts etc.

Yeah, it sucks. I believe my tenacy agreement actually states this. But you could always enquire if you can pay pro rata. The only thing I can suggest is subletting for the other 27 days. Or, default. Or, hotel for 3 days.

it is stupid, but then you should have been moving out at the end of the agreement, not afterwards without prior agreement :p

oh and unfortunately it seems that bad agents are far too common :/
 
We moved out of our flat last month (6th Dec), this was the last day of our agreement and we gave 2 weeks notice, Although the contact said 1 months notice. So we moved out at the end of the agreement. as long as you have not signed up for a longer term you can leave on the end of your agreement.

Obviously I am only speaking from my point of view and we were going through a letting agent so it may be different for direct lettings, check your contract.
 
btw, if he insists on a full month, then move out on the end of contract date and put the stuff in storage (or leave it in a van somewhere secure) and stay in a hotel for a few nights, much cheaper than £750!

But then we haven't given a months notice on the termination date. If we do it the way we are currently doing, we are fulfilling everything that is stated in the contract. We actually have somewhere to go to from the 1st (have have a weeks overlap of places to stay to give us time to move)

Every time I have moved only a couple days after the normal payment day I have been charged on a daily basis - so -- 750 / days of the month * number of days your staying.
