eBay Issue - A bit stuck with problem seller (now buyer!?!)

Ok, I need some help here.

I bought an item early December and didn't receive it. I left a decent amount of time and emailed the seller. His communication was terrible, it was unreadable. The general gist was that he sent it to the wrong person and was waiting for it to come back. I told him not to bother sending it to me and to issue me a full refund. He said (again in terrible english) that the item had already been sent to me. Still no sign to this day.

So I therefore escalate this to ebay which automatically starts a PayPal dispute. After following PayPal's requirements and waiting 10 days, I turn the dispute into a claim. The seller has a deadline to meet, which he doesn't, so PayPal rule in my favour.

I then left negative feedback on eBay. Completely factual and to the point. He then proceeds to leave me positive feedback with a near copy and paste of the feedback I left him (in perfect English now of course :confused:). Due to new rules, you can no longer leave negative feedback for the buyer. Also was a nice abusive message in poor english again.

Now the real problem. I had a number of items for sale as buy it nows and this guy has bought one. I suspect he is doing so to leave me negative feedback (I have 250+ 100% feedback over 10 years so i'd be gutted to have this tarnished). He has also paid via PayPal.

Now, clearly he is going to give me negative feedback whatever happens. I can send the item recorded delivery (it's a DVD) so he can't claim he hasn't received it. If I don't send it I get a strike against both my eBay and PayPal accounts.

So what can I do? Surely I am screwed whatever happens :confused:
 
Send it recorded delivery would seem like the best thing to do. You can pretend to say that item got damaged since the auction and offer a full refund but that would leave him a chance to leave negative feedback.
 
Well, you're screwed now yeah - you probably should've added him to your blocked buyers list before making the auction.
 
It does sound like your going to get negative feedback whatever happens.

You could send it by special delivery so you've got a fully online trackable number to give to Paypal if he claims he didn't receive it.

However if he's "clever" then he'll claim the packet was empty, the disc was scratched or something similar, so you'd have to refund.
 
That's definitely an interesting one - someone buying from you in order to leave negative feedback in retribution for an earlier transaction.

Well, recorded delivery at a minimum, and if you want to go really hardcore, go and find a lawyer who will sign, ahead a time, a sworn statement saying that the DVD is in perfect condition and working.

Of course, it doesn't stop the buying saying any old lot of nonsense just out of spite, and you'd like to think you could explain the situation to eBay but I simply don't have enough faith in them to do that.
 
Hmm yes, recorded delivery is the main option but as you rightfully suggested he can say it was damaged etc.

I didn't realise you could block a bidder, I haven't needed to before. Would have prevented this from happening!

I have sent an explanation to ebay but I fear they will take somtime to reply which may be too late. I do have his telephone number, worth giving him a call?
 
report him to ebay and tell ebay that he just bought your item so that he could get back at you and you should have added him to your block list.
 
Cancel the Auction?

1. Go to My eBay.
2. Click the Sold view.
3. Next to your listing, pull down the "Take action" menu and select "Resolve a problem".
The Resolution Center – "Resolve a problem" form appears.
4. Select "I sold an item and want to cancel the transaction" and click Continue.
5. Sign in to your account. The "Cancel a transaction" form appears.
* If you get to the Resolution Centre from your item listing, your item number is already filled in.
* If you get there another way, enter your item number and click Continue.
6. Under "Give the buyer a reason for wanting to cancel this transaction", indicate your reason for canceling and click Continue.

Best you can do is do everything by the book and send it all by recorded / registered and that will reduce the amount of things the buyer can have a go at you about.

I would also pass on the abusive message to ebay, you never know they might do something about it!
 
As far as I know there is no way to block him from your auctions. He has to actually buy I think two of your items first and not pay for them for you to be able to put the block on him.
 
Sit on the disc & fart on it & then once your Botty is hot & sticky wipe the Moisture up with the disc & sleeve.
Send this recorded & then no matter what happens you will know that the hands that feed him & handle that disc are covered in your poop.

With reference to using recorded delivery, remember that is NOT a trackable service.
So should a Paypal dipute be raised you will probably lose - only RM Special Delivery (or similar) is a true trackable service.

Good to know. My mistake was that I didn't block him immediately. Lesson learnt for the future. Just hope eBay remove the negative feedback. I'm happy with my actions so far.
 
I wouldn't bother sending it at all. He's going to claim it never arrived and leave negative feedback either way, so really it's pointless sending him it.

@OP - you mentioned ringing him. Would strongly advise against this. Keep it at distance, professional and include eBay and Paypal where ever possible.

Revenge purchases. That really is a new low.
