Involved in accident but now being given the run-around.

Why is it when you think you're being the good Samaritan to someone you end up getting messed about?

To cut long story short I gave a woman the benefit of the doubt to stump up the cash for the damage she caused to my front bumper when she managed to head on hit me at some traffic lights :rolleyes: . The incident happened just before Xmas so I told her it would do her and I a favour if we waited until new year to sort it. Now I just seem to keep chasing her up on the phone to which she just fobs me off with excuses about moving house/life up in the air/kids/etc, etc.

I knew I should have just insisted it go through the insurance instead.

Burn me!
 
I'd imagine if you phone your insurance company and explain the situation, i.e she wanted to avoid insurance claim, but is now messing you around, you should still be able to sort it, eeither that or threaten the woman that you'll go through her insurance if it's not sorted within 2 weeks.
 
If you dont want to go the insurance route you can say you're giving her 2 weeks to pay up or you'll undertake the repairs and take her to small claims to recover your costs. If it comes down to it the court route is fairly easy to do these days https://www.moneyclaim.gov.uk/csmco2/index.jsp but the threat of a CCJ against her might make her think. If you do consider this option best to start communicating with her in writing, keeping copies of all correspondance.
 
Do you have any impartial witnesses to the accident?

If not you probably won't get anywhere by going through insurance.
 
You are legally obligated to inform your insurer of any accidents (Not claims, accidents) within 24 hours of it happening even if you dont intend to claim. I wonder what they'd say finding out about it a month later? I'd suggest you go through her insurer, instead.

No, only my GF in my car unfortunately, so I'm betting the insurers would argue payment and I'd just get a "knock for knock"

This I did not know. Regarding going through HER insurance, you mean I should contact her company?
 
I keep reading more and more story's like the OP's and i think if someone was to hit me, i'd go through the insurance straight away rather than gamble on how willing the person is to pay me. Not worth the risk or hassle tbh
 
Phone her insurance company:

"Hi, I was hit by a driver insured by you over a month ago. She admitted liability and said that she would avoid an insurance claim by settling in cash. She is now refusing to do so so I would like to make a claim from yourselfs please."
