A letting agency managed to 'steal' £40,000 off my friend

It's a bit of a long read but what happened is truely unbelievable.

My friend rented a two bedrooms flat at Swiss Cottage in London from 19/09/2007 - 19/09/2008. The flat cost £550 a week and paid the whole year's rent in 1 go.

She's a Uni student and by 16/05/2008 the uni broke up for summer holiday. During the time she planned a trip home so the flat was empty for about 4 months. She contacted the agency, wondering if the agency could help to rent the flat out to someone else during that time because for 4 months it'd save her around £9000's rent. The agency agreed but stated that she must clear out her belongs because they are not allowed to bring people for viewing as long as there are people living in the flat. So she packed all her belongings to the storage room in the flat and went to live with her bf before taking the flight home on 16/06. After passing the key to the agency, about a week later she received a call from the agency saying that 1 the walls in her flat is broken, which need fixing so they could not rent the flat out yet. So she contacted the agency and said if the walls are not fixed by 15/06 then she doesn't want to rent it out and she would just keep her own luggages there during the time when she's home.

On 14/06 the wall was still not fixed so she asked the agency to give the key back to her, however she was told the walls were not fixed and the constructors had the key. She confirmed that she does not want to re-rent the flat out and went back home, with promises from agency that the flat would be ready by the time she comes back to London on September.

By 16/09 she came back to London and the agency said the wall was just fixed and need few days to tidy up. When she finally got the keys back on the 18/09 she saw 3 cleaners doing the tidying work in the flat and there were dishes out in the kitchen, fresh food in the fridge and most of her luggages in the storage room went missing. The stuff that went missing including 5 packed suitcases, which contain many designer bags, jewellery and clothes worth up to £40,000. The agent who was dealing with her flat denied that anyone lived in the flat while she was gone but also said after my friend went home, a college of his was in charge and maybe few 'gentlemen' stayed in it for a few days.

She contacted the police but they refused to help, as they said it's not a criminal case and told her to contact a solicitor.

At the moment I'm not sure what's been done, I saw the photos in her flat the only thing remains were some books and plushie toys :eek:

With she comes from a very wealthy family, the stuff been stolen are them really expensive designer stuff and the price stack up to £40,000.

If I was paying more than £2000 a month in rent on a place, I'd bloody well be staying there as much as possible, or not sign up to a 12 month contract in the first place. As for leaving belongings in the storage room, that was definitely a stupid thing to do...
 
if she had that much money to spend on a year's rent then im sure she would have enough money to put all those expensive clothes into storage or......bit of a long shot but....she could have left them at her parents perhaps ?
 
She will need to get a crime number from the police. Then give this to her home contents insurer in order to claim.

Pretty dumb thing to do though. Leave your valuables in a rented place when you know there will be random builders/repairmen going in-and-out all the time. But then, you don't get a harsh life experience much better than this...
 
Whether or not she's a Muppet is irrelevant. It's out of order and something should be done.

People who take advantage of "idiots" so to speak deserve a much harder punishment IMO.
 
Household contents insurance maybe invalid as she wasn't in the property for a long period of time. I know my policy becomes invalid if there is no one present for 60 days.

£40k, that will be a nice insurance claim..... if the muppet had it.

She sounds like an idiot. That's a bit blunt, but really..

I think she's naive but not 'stupid' per se.

Get solicitors involved over the breaking of the tenancy contract. Get signed statements from neighbours and get a crimenumber from the police for an insurance claim.
