Hello everyone,

March 2008 my uncle purchased a new 40” LCD HD TV from a well known supermarket, however shortly after he became very unwell found out that he needed another kidney transplant and therefore the TV wasn’t even unpacked and just stored in a spare room, he then decided he wanted to redecorate and there for still stored this tv in the spare room again never checking it etc…

Jan 2009, all decorating is complete and its time to mount the TV on the wall, the mount is mounted and the TV attached, we set everything else up DVD player etc and then turn the TV on.

We are shocked as everything is displaying double even menu text.

We cannot find the receipt so the supermarket refuses to do anything, we contact head office who explain the same, and they are unwilling without proof of purchase to repair it for us.

I would just like to know where we stand in regards to our consumer rights?

Thanks

IS it not stil under warranty? <12 months old? If so contact the manufactor

Edit damn you Nzyme :p

I think most places would say the exact same thing, and they have the power if you have NO proof of purchase.

I would say either contact the manufacturer direct re: warranty or if you bought it on credit/debit card, you should have a statement which will show a purchase at that time, as 'proof of purchase'

Doesn't always work - it might prove you spent £400 at the supermarket, but doesn't prove what you bought.

Supermarkets keep records of transactions, so if they can look up a specific transaction on a specific date they will know what has been bought.

We paid cash and therefore do not have a statement showing this, we should have checked the TV when first purchased, but you just expect these things to be working, at the time it cost £500, the manufacturer is TECHNIKIA, I cannot even find a website for them.

Why do people pay cash for such a big purchase?

If you can't get a warranty repair, then you're screwed. Keep the receipts next time and use plastic :)

Edit: I think TECHNIKIA are a brand name of the same well known supermarket, so you may not be able to find a site.

Out of interest, was is stored on its side or laying flat?

It was stored in the box on its stand, not in its face or on its side. It was kept sealed due to dust.

We actually went in to the supermarket who kindly explained that after 28 days they have no responsibility. Cash was trended at the time, although points were collected but apparently they are not measured against goods so they’ll only see the points added and not what they were added for.

I think Technikia is Tesco's cheap own brand.

PK!

This is wrong though. A faulty product is the responsibility of the retailer for a reasonable length of time. In some circumstances, that could be upto 6 years.

I thought the 28 day thing, and store set times, were for returning without any reason at all?

But it still is covered by a standard one year warrenty for faults AFAIK.

Edit: D'oh, beaten to it.

I had something similar with another store - after arguing with the manager I got them to search their systems using the serial number of the product and they were able to confirm they sold the item at the date/time I specified.
