Pirate bay court case

PB are going to court today in Denmark or something for a public trial, a friend of mine over there is going to watch, or try to, people have camped out over night to see it.

What's the likely outcome of this kind of case? Didn't they try to shut it down once before, shut one server, then PB opened another one?
 
Yeah I can't imagine it's going to make much of an impact.

The funny thing is, all it will end up doing is give them some free advertisement.
 
At least someone is going after the source now and not just passing down poorly calculated fines to random people.

I reckon they'll get away with it, either that or the site will be shut down but it'll be back up within a week.
 
Usually thay close a server, of the hundreds they probably use, then reopen 10 more and claim to have changed their ways
 
Isn't their members list bigger than Denmark's population or something?

It certainly is a "war" that people are trying to wage against torrent sites. Where there's a will there's a way springs to mind..
 
Bigger than the population of denmark sounds about right, these things have worldwide appeal, anyone with an internet connection can be a member.

They are not the source though; the pirate bay stores no copyrighted content on it's servers. The source are the people who seed those torrent files.

All they can be tried on is "making available" which has been a very grey area in past cases.

That argument runs in circles though, without sites like The Pirate Bay people wouldn't be seeding/sharing in the magnitude that they currently are.

Take it further than that and you could blame the people who rip the dvd screeners or crack the games. Further than that the people who provide the games (e.g. a week early) and the people who nick the work prints, screeners etc.
 
Completely agree with you. I'm not defending The Pirate Bay, I'm just saying that it's a very grey area legally, and they are unlikely to be found guilty.

Gun stores don't get into trouble when a gun they sell ends up being used in a murder...

Gun stores don't advertise themselves as a place to buy murder weapons! Try setting up a gun shop called the 'Muderers Bay' bet you don't get a license.

Sadly everyone is right they will get away with it once again as the law likes to make an ass of it's self in cases like this. Why the EU can't just pass a simple piece of legislation banning these activities specifically I'm not sure, it would definately save all these wasted trials.

Perhaps they were initially set up to allow users to share uncopyrighted pictures of a salty seadog theme :D

Remember, filesharing in itself is not illegal, it's the content of those files that determines that.

Quite, and it just so happens that 95% + of the torrents available via pirate bay are for pirated software, music and films. I don't think it matters which side of the argument your on it is pretty obvious that what the Pirate bay is doing should be illegal, is certainly imoral and they should be shut down, sadly the current law probably won't permit this.

Thing is though, TPB has NO copyright information on their servers. The torrents they store are merely hashes - they contain nothing illegal.

I haven't contested that so please read what I have said and not just post the same old lame excuses. What I have said (for those that failed to read it) is it is obvious to anyone with half a brain that what they are doing should be illegal, is certainly imoral but won't be stopped until someone passes a law aimed at preventing it.

Pirate bay also happens to be the biggest and most popular making it an ideal target like napstar in the early days. The more internet savy and technically minded, like most of the posters on this forum know that there are other more secure more reliable options while the public at large just use what ever is best publicised.

Not really, there are providing an area to store and track .torrent files. These .torrent files contain no illegal information.
