Travel agents changed my hotel - my rights

Hey,

We are booked to go to Florida late May for a honeymoon but due to financial reasons we are unable to afford to pay the rest of the holiday as well as get sufficent spending money and therefore are going to cancel and go somehwere cheaper.

What i would like to know is that the travel agent sent us a letter saying they no longer use the hotel that we booked with initially so have changed hotel. we recieved this letter late last year and was ok with it but at the time money wasnt an issue. now we do plan to cancel is there anyway we can request/demand our initial deposit back due to the fact they changed the holiday we initially placed the deposit on.

the letter they originally sent us did state that we had till end of december to cancel and we could recieve a full refund but since i did not verbally or contractually agree at any point with this change would i still be within my rights to request a full refund?

Depending on how much you value morals and integrity you could take it on the chin. You have missed the window of opportunity to get out with your refund by 2 months unfortunately.

Or you could throw morals out and claim you have been trying to contact them within that window and that you believe it is an outrage you A) cant get in touch when you need to and B) they arnt going to give you your deposit back because of this. Which would make you a dirty liar and I dont know how you will sleep at night, but I am sure you will justify it in your own head. But you will always know that your justification is just a farce you have set up to appease your mind. Therefore it will only eat away at you further.

*Im not a lawyer and just went off of what was told. Legally I would say you dont have any position either though.
 
ah well. both options sound reasonable and the fact its not costing them anything moaning about it to them doesnt really bother me... but i was on about the legal side as i will go in and ask if i can have it back or atleast try transfer it to a different holiday... its not a big issue it would just be nice to claim it back

They have cancellation policies for a reason. £350 times x number of customers cancelling could potentially be a lot of money.

I do not think you are justified in this case, and i'm sure the travel agent will quite right quote whatever their current cancellation policy is when you start to cause a fuss.
 
Im not intending to go in and start a fuss im simply planning to ask if a refund is possible... the only reason i asked is i wanted to know what my rights were. i will go in and ask if i can have a refund if not i will ask if its possible to transfer it to another holiday. failing that i will ask them on advice on what holidays they can offer and possibly book a different one with them.

cheers for the advice anyway, i was expecting it to be at best an unlikey outcome but if you dont ask you dont recieve.
 
In the back of the brochure in the T's & C's most travel companies state that they may change several parts of the holiday without offering you a reduction or refund as long as they inform you in good time.
What they choose to offer as a goodwill gesture is another matter, though if you are downgrading to a cheaper holiday I doubt they will be particularly motivated to offer you anything.
 
Write them a letter and send it recorded delivery saying "I still haven't received my refund as requested in my previous letter dated 20th December 2008". :D

It might play better if you just casually call up and ask details about the old hotel.

Then act shocked when its changed.

I think you would stand a better chance claiming their letter never arrived, then claiiming your reply did not arrive.

Just because they sent that letter does not prove it arrived.
 
AFAIK, there is a clause in all travel agent's contracts that they can change major details of your holiday, but I am unaware of specifics.
 
I was going to go on holiday last december however, due to university exams but i was unable to go......

The travel agent said we could cancel the holiday (which we had put £350 deposit on) or pay £20 per person to change the holiday, which is what we did, so we are now going to the same place next october and it works out cheaper in the end because the new holiday was cheaper haha :p

They do say that you cant take advantage of price match with internet deals but we got away with it after a bit of moaning

good luck :p and dont cancel... just change it
