Sold a phone but buyer wants refund, where do I stand?

I sold an iPhone on a forum on the 4th March and stated it was in perfect working condition, the buyer received it on the 5th and payed me through paypal gift and left me positive feedback. Now I thought the transaction was completed, roll on this morning I received a message from the buyer saying that it is faulty. He bought the phone for a work colleague and he said the colleague was off work until today, and apparently within minutes of using the phone the top 3rd of the touch screen would not respond. He asked for a refund. Where do I stand? Do I have to refund him, I was using the phone up until the we agreed a deal on the 4th March and it was perfect, with no problems.
 
was this a forum or ebay? i know you said forum.... but just checking. if it's a forum and you know you have done the right thing and you're happy it worked then it's not really your fault. sounds like a spin about the 'it was for a mate who was away' more like he had it for a few days and broke it. you don't have to do anything just do the right thing.... so if your happy you sold it in full working order. say sorry but nothing you can do.
 
If it has a fault, I would expect you should refund and have it sent back at the buyers expense.

Not a chance in hell, he left positive feed back. no one would do that wih out checking it first.

However I don't now what buyer protection is liek on gift. But I'm thinking by it's very name it is not refundable or protected.

Find out the rules for Paypal gift. If he then can't file a dispute then tell him he's stuck with it.
 
I'd be careful here, i've seen this before.

First thing i'd do is get the funds out of your Paypal account as soon as possible, and unlink it from your bank and/or cards.

Then instruct the buyer that he should send the phone back, and that when you get it back, if it is found to be faulty you'll refund him.

Whatever you do, DO NOT let Paypal "resolve" this - and I honestly think that's where the buyer will take the dispute. You'll end up with the money gone and possibly no phone either. Get the account emptied and resolve it yourself.

no not on gift... he does not have a leg to stand on 'gift' is not to be traded with.... you're thinking about ebay and paypal mate

But it was a gift and not through ebay. Can they still do that.

no, he lost his rights when he cut paypal out of the fee's by using 'gift'
 
I sold it on a forum. It was definitely in working order, I only had it replaced in December by Apple so there is definitely no problems. I do not have the serial number as I have sent him everything, unless the serial number is on the invoice of the replacement iPhone. Is there anything he can do to get his money back? The thing is I sent him the phone first before he paid me the money so there is no way of me scamming him.

walk away mate, say sorry but sorry. you have done the right thing. There is nothing he can do and there is nothing you need to do.

why send it back? he sold it working and the guy had it for a few days and left good feedback? why take it back? he sold a working phone and then gets a broken one back with no money?:confused:
 
Thats the thing, if he is willing to send me the money he can be trusted but I am 100% sure there was no problem with the phone before I sent it. If he send it to me through paypal gift theres no way he can get it back right? Cos the paypal account is in my mums name so I don't have access to her bank details to withdraw the money out at this moment.

It just seems like the right thing to do. That way you haven't lost any money, and the buyer isn't left with a dud.

Surely as the original buyer of the phone, it can be replaced again?

The warranty on the phone has ended so to repair it I will have to pay, which I don't feel the need to as it was fine when I had it. If I send the money with paypal gift to my sisters account, paypal can't take back the money right? I'm considering doing this in case he disputes soon.

he has lost money if the phone comes back duff. when stuff like this happens you have to be true with yourself.

was the phone broke? NO - then no refund. sad but true
