short story: live-in landlord assaulted me, and then denied me access to the house (which I had paid rent in advance for) by changing locks or something just as I had moved my stuff out and wanted to take photos of the room for proof that I left it in a good state.

He still hasn't returned ANY of the deposit (I had all my stuff out by 15 Feb), and now I really could do with the cash as changing job, and therefore moving accomodation, so the new place needs another deposit etc etc.

It's become obvious that I'm going to have to take this ****tard to small claims, and hopefully I can absolve him of some large portion of £££. He has admitted the assault via text, and I have copies of police reports for the date when he had denied me access, which as far as I can tell is equivalent to criminal eviction.

It's just got me stressed and can't get it out of my head :(
 
Jesus, hope it goes ok! I remember reading that thread.

I use to live around Stevenage less than a year ago... Funny bunch of people aren't they! :D

Landlord have to put deposits in tenancy deposit schemes(for the last 6-9 months i believe) and if they dont they could be liable to pay you 5 times that.

if he has hit you call your solicitor and take it from there, mind you if he is financially destitute although you are in the right there is not much the courts can do (in regards to the deposit) and is it really worth spending good money on bad.

in regards to the assault, ring the solicitor and he will advise you the best route i.e. call the police.
 
Unfortunately, the deposit scheme doesnt apply to live-in landlords. He isn't destitute either, I know that for sure.
 
Stevenage?! No wonder he's a ****tard :p Saying that, not too far from my home home (when im not at uni), near Biggleswade and Hitchin if you've heard of them.

Take him for all he's got, I remember reading your previous thread and thinking he sounded an eejit.
 
Get onto citizens advice straight away

he's already comitted a crime by evicting you. He legally has to give you 1 months notice in writing and cannot forcibly evict you (by changing locks or otherwise) until the 1 month period is up.

He's already comitted a crime by doing that, dont let him get away with any more. I would even seek to press charges on the assault charge. Landlords can be held accountable for this sort of thing. They are not allowed to just kick people out of accomodation they have paid to rent, nor are they allowed to physically abuse the people they rent to because they wont pay up or do as they say.

Ring citizens advice in the morning, they can give you contact agencies for the relevant people. landlords are accountable, even private ones.
 
charges have already been pressed for assault. first time I spoke to police about the change of locks thing, they said it was civil matter. The solicitor I have spoken says otherwise though.
 
Use your credit to obtain the funds you need for a new place all the while documenting & keeping receipts & pass them on to your solicitor for the pending court case.
Try to rest easy that the relevant processes are running & look forward.
Don't let this **** head ruin any more of your time/life.

That's a very good point. It didn't occur to me to tac that onto the costs.
 
Remember reading your original thread and thinking what an unreasonable gimp your landlord was back then, glad it's come to court.

Be very interested to see how this pans out, will be keeping everything crossed you wipe the floor with him matey.

somehow the court have received a letter from 'the claimant' on 12 Feb, advising them that the issue has been settled. :confused:

both I and the defendant turned up, and got turned away!!

Time for a complaint + claim against the court for wasting my time and money. WHEN they find the admin cockeral-up, my case will be re-instated. No doubt they will choose a date when I'm in china, cos that'll be just my luck.
