wtf, what did you do? I would've called the police on the spot. What they/he was doing sounds clearly illegal, and they will have known it.
 
It's not theft because there is no intent to permanently deprive you of it, which is in the definition of theft. This is why TWOC was invented - because you get the car back (maybe).

I know that round here one of these types was recently sent to prison for similar offences so the police can do something about it, but they probably couldn't be bothered with the paperwork - that would tear them away from handing out their quota of fixed penalty notices.
 
If towing a car away is a civil matter what you really need is a bigger tow truck to tow their tow truck away and your car and they cant object

If your council sub contracts crushing as well the council would still be in charge and have the final say i.e. any issue you have with the towing company would and should be raised with the council.

They usually refer to it as city services, and they would not just crush your car, they would give you x amount of days in writing + appeal time.
 
Private clamping/towing firms MUST have an SIA licence which must be shown on request otherwise they are breaking the law.

If you find this happens to you, the important thing is to pay by credit card and then issue a chargeback. Then take them to the small claims court. A lot of cowboy towers will claim their credit card machine is broken and you have to pay in cash, but don't accept this. You have made an offer to pay and they know they are on shakey ground.
