claiming for damaged item

Hi,

Sold something on another forum to someone and it seems the item was damaged in transit by none other than the royal mail.

anyone know where to go from here?

do i accept the item back and then claim against them? or do i let the other guy claim against them?

any help appreciated.
 
I do believe it is the sender's responsibility. It's you that has entered the contract with the courier.
 
I had this happen to me. First thing to do is ask the buyer to keep the item with them and make sure they have kept ALL packaging as RM will need to inspect it to ensure any damage wasnt a result or poor packaging. If they buyer has chucked the packaging then i think you may well be stuck.

I ended up with a cheque within about 6 weeks, but beware they ask for photos and all sorts, including a reciept for the item to prove its value

sold some guy a in-car cd player off a forum. ive got proof of receipt and sent it royal mail standard parcels.

as he's got the item should he not claim?

any help appreciated.

No, to be frank unless he paid a courier to collect it, it is ALL down to you.

You paid the postage
Its your job to get it to him in one piece
 
Depends on how easy going he is. I bought a graphics card years ago on MM, it got damaged in the post and I just got him to send all the deets to me and I did the claim.

Just spoke with the guy and he's not kept the packaging? any ideas?

Yeah you've paid them so you claim. Not sure regarding packaging wise as when I've claimed (twice) they've asked for it..
 
Well first off are these parts worth more than £36, coz thats all they are going to compensate you, however without the packaging you could well be stuffed as they will ask for it to see it was properly packaged. Have you asked the buyer for photos of the damage?

As already said as the seller its up to you to sort it im afraid
 
Was only sold for £30 so the amount isnt a worry. I havent asked for any photo's. Im going to try get to the local postie tomorrow.

As for the packaging thing. If i cant get compensation as there is no proof of the packaging where do i stand?

You're boned.

Under these circumstances, it's your responsibility to make the claim against Royal Mail. As such, it makes sense for you to have the item, so he should have sent it back to you in the original packaging, so that when the Royal Mail ask to see it you can show it to them.

With no packaging, they can't check whether it was decently packaged, nor figure out how it came to be damaged.

Refund the man and chalk it up to experience.
 
Just as an update to this:

Rang up Royal Mail, they said that as the item has been delivered it was the receiver's responsibility to make the claim.

Thread can be closed now.
 
Well thats a whole different matter. I acted on the advice given. Id be all for privatising Royal Mail, they can't do a thing right these days.
