Australlia's justice system failure shock

A while back Australia was being held aloft as having exemplary immigration laws, seen as both strict and sensible. The idea that the people behind C The Movie have been let off completely, with no jail time what so ever, is absolutely shocking, and frankly, unbelievable.

I feel like more people should know about this. I normally stay well clear of GD and political issues/debates in it so will probably stay well clear of posting in the thread, but people should know what absolute failures other justice systems can be compared to ours, even when ours has been seen by some to be a complete failure, this is surely just as bad, if not worse.

C the Movie as it was known in the Australian media was a movie made in 2006. Gang members 17 and 18 years of age sexually assaulted, spat on, unrinated on and set fire to a mentally retarded girl in a sickening attack in Victoria that was filmed and distributed on a DVD titled C The Movie.

Here is the original Youtube news report of the youngsters and the outrage. It contains nothing unsuitable for work and was shown on prime time news so none of the violence is shown.

Now what was the Punishment for this attack and rape? 20 years in Prison, 10, 5?

0.

SEVEN youths involved in the infamous Werribee sex DVD have been convicted after a judge dubbed their behaviour callous, cruel and shocking.

Of the eight who pleaded guilty six were placed on strict youth supervision orders for up to 18 months and two on year-long probation.

All will be required to attend a counselling program for young sex offenders.

And now, most recently, one of the ring leaders of the whole thing has recorded and posted on the internet a rap song about the whole thing.

http://www.news.com.au/dailytelegraph/story/0,,25325603-5001021,00.html

In an expletive-filled diatribe, the 19-year-old brags of his notoriety and vows to commit more violence.

In 2006 the thug encouraged gang members as they sexually assaulted and spat on a girl in a sickening attack in Victoria that was filmed and distributed on a DVD titled C The Movie.

He set the 17-year-old girl's hair on fire on the banks of the Werribee River.

In a song posted on a website under his nickname, the teenager boasts the attack video was viewed more "than the 10 o'clock news".

"I hope it hurts to reminisce when you think about us Werribee kids, all things we did," he sings.

The teen escaped jail over the crime but attacks "cunning judges", saying they can all "get f...ed".

Victims of crime advocate Noel McNamara said yesterday the song proved the teenager treated his crime as a joke and should have been sentenced to jail.

"It's disgusting," he said.

Eleven youths were charged over the humiliating Werribee DVD, with most placed on youth supervision orders. All were required to attend a counselling program for young sex offenders.

The teenager sings that the gang did not need to be tested "because we proved we're worthy" and that his "fame will never end". The song refers to the victim by her first name.

Singing along with two other amateur rappers, they expose themselves as violent racists.

"I split lips and f... I hate nips," is one of the rants.

They also boast about bashing people and leaving before police arrive.

During the rap song, youths can be heard laughing at news sound bites deriding their actions.

Utterly disgusting. I simply cannot understand why the sentences were so light. My blood boils when I read about it.

Well the way the are going after the sentences were carried out, it's only a matter of time before the **** meets the fan for them.

has it been explained why the punishment was given?

do they automatically get shortened sentences if they plead guilty and other such things. It may not be the judges fault.

People like that always dig their own holes.

It is just a case of whether the hand of the justice system or a vigilante pushes them in.

What worries me is their objectification of 'the victim'. As soon as you do that, you lose all responsibility and guilt for your actions towards them and that's a dangerous thing. It means the step to a much more serious crime is trivial.

Hence why a deterrent is needed.

In my world they would have been sentenced to 10 years minimum. Whatever their young age, nobody can argue that they are not a danger to society. It is a truly awful attack and I will bet that the family of the voctim have had any faith in the justice system shattered.

If they keep going on and acting like they are i wouldnt be suprisewd if the locals punish them more then the judge did.

There was also a failure in WA a few months back which even shocked the PM

The mother of pole-axed policeman Constable Matthew Butcher today slammed the WA justice system that acquitted the accused assailants of her wheelchair-bound son.

In an emotional interview with Radio 6PR's Simon Beaumont, Gail Butcher confirmed that one of the 12 jurors sitting on the District Court trial was 'turfed' two days ago because they mentioned they thought the three male defendants were guilty.

Robert McLeod, 56, and his two sons Scott James, 35, and Barry 29, faced nine charges including assaulting a police officer, making threats, and obstructing a police officer after a violent episode outside a Joondalup hotel in February last year.

Barry McLeod faced the most serious charge, of acting with intent to harm which endangered the life of Constable Butcher, after the police man was felled by what prosecutors dubbed a "flying headbutt".

Last night a jury acquitted the McLeods of all charges except one involving Scott. He was found guilty only of making threats to kill the civilian who recorded the headbutt on his mobile phone.

"My son has been maimed for life," Mrs Butcher told Beaumont on 6PR's Morning Program today.

"You can do what you like these days.

"We're lucky we've still got Matt."

Mrs Butcher said money talked in the WA legal system.

"When you have got lawyers like that, money speaks many languages," she said.

"If that's the way Australia's going to go - (the McLeods' lawyers are) very clever men, there's no doubt about that.''

Mrs Butcher recalled how as a youth Constable Butcher "passionately" wanted to be a policeman.

"He is my son and I'm a bit one-eyed, but he was a very good policeman," she said.

"He wouldn't hurt anybody.

"The last thing he remembers before waking up in Charlie Gairdner (Hospital) is ringing his grandmother for her birthday."

Mrs Butcher said yesterday's acquittals left her feeling "numb".

"You just wonder how 12 jurors can make that verdict," she said.

"Down the track, I hope those jurors never need the police."

Video of the attack in the link aswell

IIRC they got off because he had pulled out his Taser:confused:

In a quite lawful and justified show of force.

A police officer using a Taser in the lawful application of force who is then headbutted and felled is the victim of an assault while executing their duty.

I don't see how the headbutt was justified in any way.

It is shocking. My mind is a bit preoccupied today but I don't see the link between this and immigration.

Sorry to post this on a serious subject but it looks so good with your signature banner :D

The court heard the 17-year-old victim, who is mildly intellectually delayed

What does that actually mean? Theres nothing wrong with her and shes just a bit thick?

Was she screaming and crying or was she more compliant?

Here we go. I found the one that explains it more

THE acquittal of a father and two sons on charges of bashing police in a brawl that left one partially paralysed has sparked a huge outcry, causing the West Australian police commissioner to warn of resignations from the force.

Constable Matthew Butcher was paralysed down his left side last year, after trying to break up a brawl outside a tavern in Perth's northern suburbs involving Robert McLeod and his sons, Barry and Scott.

The McLeods - who were represented by top Melbourne silks Colin Lovett and Con Heliotis - were charged with several assaults against police but were acquitted of all those charges on Thursday.

The jury reached their decision after a six-week trial, during which they were shown mobile phone video footage of Barry McLeod hitting Constable Butcher from behind in what was described as a "flying headbutt".

The jury handed down a conviction on only one charge. This was against Scott McLeod, who was found to have threatened to kill a member of the public who filmed the brawl on his phone.

Scott was fined $4000 in the District Court yesterday. State Attorney-General Christian Porter, a former prosecutor, yesterday described the footage as one of the most horrific things he had seen in criminal justice.

"It made me sick to my stomach to watch it," he said.

Prime Minister Kevin Rudd, in Perth for the funeral of Bev Gallop, wife of former premier Geoff Gallop, said he was "stunned" by the case, and the community needed to get behind the police.

Constable Butcher said the video was "the most cowardly thing" he had seen.

Police Commissioner Karl O'Callaghan said he was "thoroughly disgusted" when he watched the footage, and he found it hard to believe no one was to blame for Constable Butcher being hit from behind.

He said two officers involved in the case had already resigned as a result of the verdict, and more might follow.

"I wouldn't be surprised if I get more," he said. "I think the losers out of this process will be the community of Western Australia. If police officers don't feel protected ... they probably won't work as hard."

The decision has led to heated debate about the role of juries in the criminal justice system, and while Mr Porter said he was a supporter of juries, he wanted to clamp down on the number of excuses people could use to be excused from duty.

Mr Porter also flagged two major changes to criminal law, restricting self-defence laws and penalising accused criminals if they chose to use the right to silence.

He would look at replicating changes made to Britain's right to silence laws, which penalised people if they did not tell police early on in the investigation the reason behind their actions and instead raised it later during a trial.

But one of the McLeods' lawyers, Michael Tudori, said yesterday it was an "absolutely disgrace" that Mr Porter and others had criticised the case when they had not been present at the trial.

He said the McLeods had been protecting themselves and family members from excessive police force, The Weekend Australian reported. "The jury's verdict was unanimous in that the police used excessive force; that's how and why they were acquitted," he said.

"The police should be looking at and reviewing that footage as to how they behaved."

Mr O'Callaghan said police would look at mounting a civil action against the McLeods, but Mr Tudori said the family was not concerned by this and may take their own action.

He said Robert McLeod was still suffering from the effects of the brawl, in which he was struck with a Taser gun.

In conclusion. The Mcleods and the Lawyers are scum:(

And people think the grass is greener on the other side, all those brits who have jumped shipped to Aus, lets face it every country is the same it has its good and bad people.

It is shocking. My mind is a bit preoccupied today but I don't see the link between this and immigration.

6 or so months ago, the Australian PM was held aloft world wide as king of responsibility, modern values and anti political correctness when he spoke frankly and in many peoples opinions correctly on immigration and what it should entail. This is in stark contrast to that.

Very well, I still don't see how it connects though.
