Right. Here's my opinion on the matter.

TPB host torrent links to copyrighted material yes, but they do not hold ANY illegal content on their servers. This means that they *should not* be prosecuted for any law related to the storage of copyrighted content on their servers.

However, this means people accuse them of providing links to copyrighted content (which they do). Some people liken this to someone telling people where to buy drugs, or directing someone to illegal material, aiding if you like.

This is where I disagree. Users who wish to download illegal material go to TPB. TPB does not contact them or say 'Go here and download this, go here and download that', it merely acts as a platform SHOULD they decide to download it. I'd hazard a guess that most, if not all, PB users are aware that they are breaking the law, as they made the decision to do so. They clicked the link; they were aware that they were breaking the law, yet they continued to do so.

It also works if you use an example of buying firearms in America, or anywhere where you can quite easily get hold of weapons. If they buy the guns, then shoot someone with them; the firearms dealer is not at blame, are they? If this was so, a lot of companies would have gone under (think Walmart etc), and been forced to stop selling them. The person in question decides a) to buy a gun, b) to shoot someone, no-one is forcing them to do so (in most circumstances).

That's my stance anyway.

Edit: Another thing for those talking about CDs/DRM, did you know that it is actually illegal to copy a song from a CD (that you legally purchased) to your computer, in the UK? Many people do so anyway.

Thats not what they are being prosecuted for? Wasn't the what was dropped from the charges like a day or 2 into the case?
 
Incidentally, one good initiave is Spotify. I think that is brilliant and had it not had a massive chunk of music removed recently because of licensing companies. It has an acceptable quality for 'trying out' a band or casual listening at work and so on (OGG V at 160k).

Wonder if they'll close it down. RIP Google. :p

Yes, they are not charged for hosting illegal files but they are prosecuted for aiding people, I guess because they did not remove copyright protected torrents from TPB.

£3 million actually. And as the site is still up, I'm willing to hazard a guess that more than £3 million worth of material is downloaded/uploaded on a daily basis...

Its more the message that it sends out though isnt it, that they are 'cracking' down... not that it would work, when the piratebay closes iam sure 10 will spring up in its place...

No. Else they would have been banged up a long time ago. Much worse stuff than dvds, music or games can be found via google.

Yes it was, my mistake sorry. They are being prosecuted for aiding, correct? That's something I really disagree with.
 
those who are saying torrent is dead , its slow etc. there are 2 types of tracker, trackers open to the public and private trackers.

private trackers have a user base were by those participating in a torrent seed for much longer as the tracker forces a ratio system were if you go below a threshold you get penalised.

people value their account as the benefit for having a healthy account is that you get to download what you want with speed and ease. all popular torrents are heavily seeded with few leechers. this means you max out your connection .

public trackers are the opposite, no incentive to share thus making popular torrents heavily leeched. much longer wait times .
 
This aint good, if PB peeps lose their appeal, how long before the RIAA and MPAA go after the ISPs? They are doing exactly the same, assisting with copyright infringement. Bye bye privacy.
 
omg omg omg omg omg, I have just had an idea!!!!!! no one will have thought of this surely!!!

Its like steam for valve stuffs, but would be called Dream or summit. Punters simply pay for movies, tv shows, music & games on their "dream" account. Much the same as steam/impulse.

It would have different fees depending on how many TV shows you wanted to download and keep each week/month, same for albums, games and movies.

This could go even further, say you wanted to keep your downloads of say Heroes season 3, you could pay a one off fee for it thats cheaper than traditional etailers and high street stores.

no, do you go after the people who made the car you used to deliver drugs to someone?

difference with tpb and isp's are tpb facilitate in the discovery of illegal content, they introduce you to people who have illegal content.

isp's on the other hand are a conduit not a facilitator.
