Pirate bay court case

Why? Its utter garbage. Anyone with a half decent sound system it would be criminal. And why pay over the odds for a few MP3's when for cheaper you can have WAV files on a CD.

As always ignorance is bliss when it comes to the majority of the populous.

What do you use then?

difference with tpb and isp's are tpb facilitate in the discovery of illegal content, they introduce you to people who have illegal content.

isp's on the other hand are a conduit not a facilitator.

Maybe they won't try to sue ISPs over assisting copyright infringement at the moment, but it wont be long until ISPs will be forced to disconnect their users for copyright infringement or face fines themselves. Several countries have already adopted the three strikes and your out rule.

To use your analogy, these organizations will pressure the car companies into producing camera filled transparent cars in order to make sure a person isn't using the vehicle to transport drugs.
 
There's millions of better MP3 players than iTunes and all of them don't use the restrictive DRM that iTunes use.

I remember reading some article a short time ago about an interview with a top music exec. He knew that the old model was not long for this world and in a few years the entire industry would have to change or die. However in the mean time the old model is still pulling in vast amounts of money, so they would continue to sue and lobby for changes to law as long as they could.
 
Apologies I haven't read the whole thread but why hasn't Mininova had this many issues? Is it the difference between refusing to take down any torrents and taking them down when asked that has protected them? Sort of the same attitude Google have with youtube.
 
Just been watching the press conferences on this and, to reiterate, I can't believe what has happened.

They 'leaked' the trial results out early (107 page document) which is illegal.

This isn't actually a result - this is part 1 of a possible 3 tier system which they reckon could take up to 5 years to get a final result.

Mass deminstration in Sweden tomorrow. Guess there President isn't going to be happy as there's a lot of people who won't vote for him next time around.

They asked if this was a civil or political trial (as there are different laws dependant upon which one) and no answer was forthcoming in the document they have found them guilty on both scores and when they couldn't find them guilty on one they moved on to the other. This doesn't make any sense.

Laws constantly changed to benefit the prosecution.

I have several comments on this:
1) The court case was farcical - the prosecution were allowed to get away with far too much
2) The case has no legal significance outside Sweden
3)I'm pretty shocked with the judgement and imagine it will be reversed in the court of appeal - if for no other reason than this is deserving of moving to their supreme court for a proper discussion
4)does anyone know if anyone's translating it in to English? I'd love to have a read through.

Yes it is being translated to English - I couldn't quite make out what the guy who runs TPB was saying but I believe it will be made available by Swedish PirateParty. You have to understand that the document was leaked prior to the court announcing it's verdict. This should, in most countries, lead to a mis-trial.

I don't think so. They just targeted TPB as they are bigger, and feel that taking them to court will make other sites reconsider.

I find it incredibly ironic that all the media attention from the court case has just made even more people aware of TPB.
 
Agree with Stokefan - even if the intention is not there the actuality is there which it is all judged on. I may not set out to say run over someone but I could end up there.

Are they though? I think TPB has more torrents but I'm pretty sure Mininova gets more visitors. I've always been surprised that they're rarely mentioned in new articles, it's always TPB. I find Mininova a far better site to use.

No what I am saying is that if TPB are found to be illegal then so should google as the end result is the same. The argument that they may not have meant to do it doesn't mean they haven't done it and thus the end result is the same.
