Changed mind about buying a second hand car - need help!

stoofa is talking rubbish, just walk away, no contract has been entered into.

Umm - he has already said he has signed.
How exaclty am I talking rubbish?

Do some research into the situation and then come back when YOU know what you're talking about.

He does, and i took a look at it. The paragraph i found to be relevant said that if within 14 days of the buyer being told the goods are available, the buyer doesnt pay, then the deposit if forfeited (fine) and also needs to pay any expenses/losses suffered by the seller as a result of the cancellation.

I do not see how it would total £800. I asked for a list of what these costs are, and they said £100+ for servicing, plus costs for adverts etc. Didn't say how the 10% figure came about, other than 'it's what head office says'

He's in his 30s. The main problem causing the high insurance premiums is a 6 point penalty he has for recently driving without insurance.
Corsa is a 1.2, 1 year old.

Then he should get a 2004 Clio or similar for what, £3000 for a decent example.... put what's left towards insurance and keep that for a few year while his points drop off and then he can get something decent.

This...

I can't comment on the legality of the contract I'm afraid as I don't know, but the idea above is really the best course of action. Swallow the insurance cost but with a cheaper car for a couple of years before they can afford to insure a nicer car. Then spend the larger 8k budget.

On a separate theme, 8k on a Corsa? I've got to agree with others, I can see the appeal of buying nearly new, but there are hundreds of other nearly new cars I'd rather have. I just don't get buying a car like that with a budget like that. That's just a personal opinion though!

Tell him to put up with the insurance, surely if he has 8k to waste on a corsa then 1k or so on insurance should be an issue.

£100 deposit AND 10% if cancelled? Are these 2 charges for exactly the same purpose - i.e. you put a deposit down in case the sale falls through and the dealer has to readvertise? Even if the dealer turned down a buyer in the meantime, how is £800 going to help - even Corsa don't devaluate that much within a week for example.

 I am 29, with 6 points on my license, i am looking a buying a 3.0 v6 mondeo st220 for £7k -£8k and i'm getting insurance quotes of £900!

Over £1k+ @ 30 years old with 6 points for a 1.2 corsa seems obscene

a) What is a 30-something year old man doing buying a childs learner car anyway? He will look ridiculous in it.
b) Even with an apalling driving record the insurance on a Corsa is going to be as cheap as they come. Just what does he expect to buy for his £8000 that will offer a significant insurance saving?
Oi! I still drive my old corsa and I'm 30 tomorrow. Go do one please :P

with that type of attitude to money, no wonder he decided he didnt need to pay his insurance.

As already said, just swallow the cost of the insurance, nothing is going to be any cheaper. Its the INS10 code on his license that makes insurance expensive, not the car.

a) he originally wanted a BMW 31x but the insurance was too much on that or something. so i think he chose a corsa pretty much for the relatively cheap insurance. he did a quote with it originally but missed something out i guess.

b) I checked for him earlier on confused.com, the cheapest was £1k+, which went down to £500 if the 6 point penalty offense was omitted.
Balls, Im sure insurance can be had cheaper than that. I have a clamin against me on my insurance and yet my renewel only costs about £250 which can be had cheaper if i get some money back via quidco.

How much was your claim? When was it? Did you recently get 6 points for driving without insurance? If not, then it's not 'balls'. The insurance IS that high, but isn't really my point.

He seems to have decided on not getting the car, and wants to know how this 10% came about. He will probably be contacted by Arnold Clark's head office soon, with their request for a cancellation fee.

Why put a deposit and agree to buy a car without getting a quote 1st. It's not exactly hard to call even when you're at a dealer.

Ok, maybe i was over the top, but it seems a tad high. Maybe the buyer has seen the light and realised that corsa are indead pap :D

I think your friend woke up one morning and said to himself, "Did I just sign 8k moola away on a CORSA yesterday?!?!"

If it was me, forget the 100 notes (obviously) and don't bother going back to the dealer. Ever.

That is the intention (as is hopefully implied in my OP). The main concern now is whether he'd get taken to court/sued (the main point of my OP which most people seem to have ignored).

Still waiting on them to send something, i'd be very surprised if they didn't.

If you haven't alerted them to the fact you don't intend to proceed, I imagine it would sit as a sales lead somewhere, indefinitely?
