Took the Z4 for its MOT at the main dealer. It failed on a rear tyre.

This suprised me, as I keep on top of tyres. It's about ready to change the tyres but I didn't think they were illegal - certainly, it wasn't down the treadwear indicators yet. But hey, its failed it's MOT, so I guess its illegal. Obviously then comes the hassle of getting tyres done at short notice which I've criticised people on here for before now!

Luckily I managed to haggle them down to the Mytyres price for the Eagle F1 Assymetrics I wanted, so no issue. It's going back to get them fitted tommorrow.

Decided to throughly check the tyres tonight to satisfy my curiosity. Used a tyre tread guage and found that at no point on the tyre which had failed as there less than 1.6mm of tread. Infact most of the tyre was at 3mm and at no point was the tread level yet inline with the treadwear indicators. In my opinion, it is a legal tyre, yet it has failed an MOT.

Would you say anything? I'm in two minds.

a) You cant go around failing cars for things which are not illegal. Especially when you tend to trust main dealers. It's outrageous!
b) Who really cares anyway, frankly it needs new tyres and I was booking them to be done at some point next month anyway, and the price is good.

I just cant help getting this niggling feeling that somebody is getting ripped off. On this occasion it isnt me as I wanted new tyres for it and the price is good but... what if I hadn't have haggled? What if I'd paid main dealer prices for the new tyres I thought it was critical I had (No time to order online and bring back without incurring a retest fee...)?
 
They taking you for a chump dawg, I would make the stand on principal.

But be prepared to be made to look like a fool if they are actually illigal for a some reason you haven't thought of.
 
Id kick up a fuss myself. You never know they may knock even more off the tyres.. Doubtfull but still its not on.
 
I would be asking why it has failed, getting the dealership to show you and reading the MOT handbook carefully.

As far as I was away they couldnt fail you for the tyre wear only advise you of it unless it was actually illegal.
 
If it were me, when I took it back in for the tyres I would probably ask them to show me where/how the tyre is illegal and what caused the M.O.T fail.
 
If it failed because it was below 1.6mm an it clearly isn't, at any point after your checks, ask them to show you where and if they can't then ask them for your MOT certificate as they must have made a mistake...
 
Just go back to them as ask them to explain to you how the tyre was below 1.6 when you've checked it all over etc.

Not at all. I'm just musing. Mostly because frankly I want them to fit the tyres anyway so although the fact it failed its MOT has no real effect on me I cant help thinking that its just.. not right :p

'Oh, we're sorry sir, we'll issue the certificate and not replace the tyres'
'Oh but actually can I have the tyres anyway'
 
Ask them to show you where it's failed just to 'satisfy you're curiosity' whilst they are changing the tyres. They may knock a few quid off the Eagles for lying to you if they are wrong.
 
Stop off at a local tyre dealer before you go, get them to check your tyres, (it will be free) go back to the dealer, mention your findings and should they not co-operate mention that you will be contacting VOSA with your findings, your MOT will magically appear before you.
 
That's not on, I'd be back in there complaining, threaten to report them to VOSA and don't be surprised when they are suddenly offering your money back ;)
 
I would get a second opinion from a tyre fitter as proof, then bring it up with the dealer.

If there was nothing wrong with the tyre, I would be buying my new tyres form elsewhere out of principal.
