3D Realms sued over Duke Nukem Forever

Take-Two has launched a lawsuit against the creators of Duke Nukem today in an effort to seek compensation for investments made on a project that was never finished; Duke Nukem Forever.

The (too)-long-awaited sequel to Duke Nukem 3D, Duke Nukem Forever, was in development for at least 12 years, but the project eventually collapsed on itself recently when developer 3D Realms closed down under financial strain.

Over the years it seems that Take-Two, who was to publish the much-derided title, invested upwards of $12 million USD in the project and, now that the game will never make it to market, the company is seeking compensation by suing Apogee Software Ltd. It should be pointed out that Apogee Software Ltd is the legal name for 3D Realms and shouldn't be confused with the still-alive Apogee Software LLC which is still hoping to publish the original Duke Nukem platform games on handheld platforms.

The lawsuit is based on the fact that 3D Realms promised multiple times that it was working on DNF, but the game never really progressed close to a shippable state and was delayed by constant engine changes and tech-tweaks.

"Apogee repeatedly assured Take-Two and the video-gaming community that it was diligently working toward competing development of the PC Version of the Duke Nukem Forever," reads the complaint, according to Bloomberg.

Among other tactics Take-Two promised cash-incentives to key staff members if they could get the game out in time, but it was a move in vain and it seems that Duke Nukem Forever never really had a chance of getting to market.

maybe they should resurrect the game and release it them selves :D

Can't say i'm suprised. if you've sank 12m into something you'd want some results. I don't think continuing development would be a wise move here, the game is clearly no good, as it would have been out already, even if slightly rough around the edges. Too much water under the bridge, should be cut loose forever.

Could release what's been done to the public and let it become some sort of open source development, there seem to be plenty of people interested in seeing it finished.

u will never keep up with new game engines that are developed what the hell they were thinking :confused:

how ever unreal 3.0 one of most popular at moment maybe thats why they switched
 
getting full rights of the game tittle ^ ;) its worth more then 12 mill . and maybe project and material that was created even if not complete

That's just poor business practice from Take-Two really. If they're stupid enough to not actually look at the product someone is developing for them they deserve to be duped.

Also, Take Two didn't invest $12 million over the years, they paid that amount in 2000 for the exclusive rights to the game. For the most part, Duke Forever was self funded. According to the comments here (look for the one from Scott Miller), 3D Realms didn't receive a penny of the money. Take-Two just spent on advertising when it wasn't really needed.

lol with $1.2 million let alone $12million I could have had the game up and running inside a year and ready to go gold inside 2 years.

(Well maybe £1.2m rather than $).

Yes, but there's a difference between your standards and those of 3D Realms. If I remember correctly, a release candidate version of the game was ready in 2006 and Take-Two wanted to publish. 3D Realms however were not happy with the final product and got it pulled.

Why didn't Take-Two have a problem then? Why after 9 years of development didn't they turn around and say "not good enough"?

All the journalism at the minute seems to be very one sided, mainly because we've only heard one side of the story. Can't wait to hear Broussard and Millers takes on all of this.
 
I really don't blame Take-Two for sueing 3D Realms after having sank 12 Million into it. Took them a ridiculously long time to release the game and they still didn't finish it. Derserve everything they get imo.
 
I'm assuming they're gonna go for the pockets of the guys in charge of 3D realms tbh, i'm sure they're still loaded in comparison to your average person.

and as someone else mentioned, the full rights to the duke nukem franchise and whatever else they've done over the years, but i guess if take two dont have a team of actual game developers that would be quite useless. are they purely a publishing company?
