I sold something on eBay and the buyer says it doesn't work. What shall I do?

The 10years building with the spec he gave you sounds questionable, why on earth such a PSU :confused:

Did you put a disclaimer on your auction stating you would not be held responsible for compatibility issues or such?

On 13th the guy did a resolution thing, no replies after i said i'd refund if he sent it back with original packing and i tested serials match and if i saw signs of tampering or damage by buyer. After a week due to no responces I said I will no longer offer refund and asked for feedback and ill do same.

I got the money eventually by talking with paypal saying i had passed the 3 days of postage proved that it was delivered. Quickly i transferred money to my bank account. After which i closed the direct debit through online banking and wiped the bank account and solo card from paypal. I then decided to close my paypal account.

Today i just received a email saying the buyer has responded to the resolution then another email saying he has escalated it to a claim. Paypal email said have the money in paypal incase he won the claim.

Since i do not have a paypal account and no money in it and no bank or card info in now. Is there any chance they can go to my bank and demand 94 quid from me and the bank will give it to them without my permission? I do not think they can get it back but what will you suppose will happen when he cant get his money back.

if you dont have an account setup with paypal, if im not mistaken no one can take any money from your account from your bank, thatd be a serious breach in my opinion
 
Should be a clear case tho paypal/ebay always seem to side with the scammer :(

You've given him the option of returning the card for a refund and make it very clear to paypal, etc. that you have offered that option and the buyer has made no effort to take it up. This should be clear enough for them to deny the claim - you have all the correspondance on your account ffs.

If they come after you for the money reply that you will pay them duly when you have confirmation of the card being shipped back to you otherwise you will take it up with small claims and like wise make that clear to the buyer. This is a resolution that can be winnable in court if it ever came to that (which it won't unless you want to throw money at it).
 
I agree with what Rroff has said, you gave him every chance and it seems pretty clear now he was trying to pull a fast one for whatever reason.

Your money should be fine now, i've never heard of paypal demanding money from your bank on a customers behalf. My guess is they'll forget about it sooner or later.
 
What will happen is the account under the email address you used will go into minus. The amount of money owed to the buyer (if the Paypal claim goes in favour of the buyer) will be applied as a negative sum onto the account. Paypal never chase up this payment though and just ban the email address after a certain period of time. If you have closed the account I'm pretty sure they can't do anything anyway. It's illegal for them to make an unauthorised payment on card details that you have removed. They would severly be breaching some sort of privacy legislation.

They don't go to your bank. They refund the buyer, then they issue you with a claim for the balance. If you do not settle it, they transfer it to a debt collection agency.

Really. That is exactly what they do now.

Six to seven months ago they would tell buyers who made a claim against a seller that had cleared out their account that there were no funds to claim against. They do not do that any more. They refund and come after you.

I can't see this having a happy ending now really. Maybe you should have checked out some ebay forums first as you made some really bad decisions that are not going to make things any easier for you.

If the buyer ever did supply a tracking number you are shafted unless like one post suggested you video record you taking the mail to the point of install and testing and even then that would only be relevant if you decided to pursue small claims over this. If you really wanted to ensure a return was legit (and not a bunch of old newspapers) you would have to film it from delivery to the police station and open it in front of a policeman to have any real value as evidence.

If they decide not to return it, you've closed your Paypal now? So you can't fight the chargeback. You loose automatically. They will send a debt collection agency, so be prepared to pay up or challenge the T&C you signed up for in court.
 
Grr now im gutted if they do that. I really hope it doesnt come to that.

Wish the buyer just admitted he had a poor psu for it and droped all this crap and just resold it on instead. Would have saved us both a load of bother.
 
Yep - they can't take it from your bank account if you've disassociated it from your PayPal - they'll just pass it onto debt collectors (who will probably chase you for the original debt plus a nice fee for their trouble.)

In that case id take the buyer to court for the cost of the GFX card since i assume the buyer will still have it in his possession
