My house mate owes thousands and now people are knocking on the door!

Surely a big problem for the OP is that if a CCJ is obtained against his mate then its his address that is shown and this will adversely affect his credit rating.
 
Chances are that these are not bailiffs but Debt Collection Agents, they can huff and puff as much as they want but they've got no power to seize goods (well, maybe they could clamp the car).

He needs to contact either CCCS or PayPlan and get their (free) help.

As atpbx said if they keep calling then ring the police and say you're being harassed/threatened by them.

If you sign up to the Consumer Action Group forums there are plenty of people on there who'll be able to help.
 
just spoke to a friend who i found works on a local estate offering free debt advice and does not charge, it's a charity based one. He's willing to help but my house mate has to be willing, which is the issue.

i thought about speaking to his brother who is pretty minted and his girlfriend, but i really wanna get through to him and make him wake up and smell the coffee so i think i will confront him tonight.

concerns...

1 - my friend and his quality of life
2 - scum coming around my house 3 or 4 times a day looking for him
3 - my credit rating and loss of my property however unlikely that may in reality be
 
Well I'm not going to argue with you, the OP can check it out himself.

Your right they can't force entry though, however they can and will use all sorts of tricks to get you to let them in.

There is a risk that dodgy companies he owes money too will employ dodgy people. They are quite happy to take cars back without court orders etc.
 
just had a positive chat with him, he was still cagey about how much he owes but agreed to speak with my friend who does free debt consultancy...... making it happen will be another thing!
 
Your credit rating will not be affected as it doesn't go off the address any more.It only goes off your individual circumstances unless you have a joint account with a partner etc which would be a factor.
 
FWIW - you don't have to kick him out if he's been your mate for 15 years - Bailiffs might talk a bit but in reality there is nothing they can do - they can't come into your house unless you allow them to or leave your door unlocked.... am pretty sure they can be officially warned against harrasment if they go OTT in chasing the debt. Something else to speak to citizen's advice about perhaps...

true, next thing you do if they come round, you need to ask for a copy of the contract proof of debtness, if they dont have one and they carry on bothering, you can take them to court. Next thing your mate can sell you his stuff for a nominal fee and you give him a recipt that way he has nothing that they can take, if you have any goods with no proof better get your father etc.. to make you recipt just incase.

apart from getting him advice which you have done you also need to protect your own goods.

you said you have rented the property i think

you can either move out

or

go to see the landlord or letting agency and renewing your contract so it shows that you have just moved into the property...if someone comes knocking claim you dont know who he is(your friend) and show the new tenancy agreement...aslong as his name isnt on it they wont bother coming back.

you could probably always get a hold of 1 from someone you know or the net and fill it in yourself but that probably isnt legal:p
 
You sound like a good friend. Shame there aren't more people like you in the world.

I hope that you can get this resolved.
