Signed an Agreement now he wants more (vague i know)

it also annoyed me that he knows im working 200mile from home and still expects it down NOW! cant see how hes right. he has 3 weeks to wait yet.

he's screwed me over at work in the past with money so he will have to wait untill i am ready (still within agreement dates)
 
You seem to think the winglets will turn up, once ordered, already painted?
There is also mention of glassfibre ones being cheaper than original carbon ones.

Surely if it has OE wings on it then you will have to replace with OE wings and stump up.

I'd personally pay extra, to have the car professionally polished / buffed to MAKE SURE the panels match.
 
What relevance does a written agreement have?

If you borrowed it rather than rented it, it was a favour rather than a business transaction, and as such you have a moral / gentleman's agreement responsibility to return it to condition ASAP, and ASAP doesn't mean when conveinient to you.

He's out of order to insist that both wings are replaced, unless when the first is replaced they don't match. He shouldn't insist that they are replaced speculatively. That said, it's not difficult to see why his nose might have been put out of joint by the way you're acting.

From his perspective, it's not hard to conclude that he did you a favour, and that now you're finding every excuse under the sun (overdraft, stuff, working away, being paid late months ago, a mate who's fallen on hard times, 'finding out' you've been paid, etc) to be difficult and it's a slap in the face.

None of this is his problem. Between you and your mate, the moment you were back in the UK (if not before tbh) you should have been on the phone with a credit card to get things fixed, and gone out of your way to provide regular updates on what is going on, so he didn't have to chase you. It would then be your responsibility to figure out how to pay for it after it's fixed, and he's enjoy the rest of the summer, safe in the knowledge that he hasn't has the **** taken.
 
Why did you borrow a car like that from somebody who had 'screwed you around' anyway?

Why is every thread you post lightly sprinkled with a seasoning of 'WTF'?
 
Have you still got the wing that snapped off? If so, no chance of repairing it and reattaching it? colour shoulnd't be an issue then unless it took some tarmac damage when coming off.

Nonsense, he's got till the 14th of september to put it right, thats the agreement he signed thats all he has to abide by.
In fact, I would even be arguing as to why its ME who has to replace parts that have failed due to fatigue and not my negligence.

Only thing this guy has done wrong is that he was silly enough to borrow somebody else's poorly built sack of crap track car to do a European tour in.

If coloured gel coat, then this is pretty obvious.

Who mentioned the originals being carbon? Very unlikely on an older Westfield unless the owner has 'upgraded' them in the past.
 
Get it sorted within the agreed dates (when it suites you) and only do the wing that you actually broke.

It's utterly ridiculous for him to expect you to replace both in a set.
 
If you want to be a good chap and fix the car from a moral point of view to the position it was before, get all the work done. If you want to keep to the letter of the agreement fix the problems and hand it back to him. Its then up to him to decide if its worth taking you to small claims.

Personally I would do it all but I wouldn't have the wee taken out of me - which I guess is how you feel?

It doesn't matter what the ex-boss says between now & that date.
It doesn't matter what Stinky does to the car between now & that date.
It doesn't matter what Stinky spends his money on between now & that date.

By September 14th Stinky does however need to return the car in exactly the same condition as when it was originally handed over, i.e. as was signed & agreed.

If both wings are NOT in exactly the same condition as when borrowed - Stinky is in trouble.
If both wings ARE in exactly the same condition as when borrowed - ex-boss cannot moan.
etc etc


I'd return the car to its original borrowed condition as best as you can but it sounds as if the ex-boss is a bit of a Rupert & your likely to end up with an argument on your hands when you come to hand the car back over... but if we're honest you knew he was like this before you borrowed the car...

Where does this colour matching stop though. What if the nose cone is faded and doesn't match the two new wing's, or other panels for that matter. Will he need to replace them as well because the colours no longer match. I'd personally just replace what was damaged or faulty within the agreements timeframe and leave it at that. Thats what the agreement states.

Absolutely, thats all he can do.

Its then down to Stinky how he argues this out & his relationship with the ex-boss, but if Stinky does honestly feel that he has repaired all damages incured as agreed, he might have to give him a 'Fluff Off, I'll see you in the small claims court!'.
(Ickle note: the above is only based on what Stinky has told us about the ex-boss, he may turn out to be a thoroughly nice Cliff Richard!)

exactly, the money i got paid was used to pay off debts that needed paying, i did this knowing that i would get paid again the following week and get that sorted then!

and surely im not really making excusses as i still have 3 weeks per the agreement to sort it

I just can't envisage a situation whereby I could take this sort of attitude about something I'd borrowed... If I'd rented it, that'd be different... But borrowed? I'd be embarrassed by this...
