Fraudulent Claim Against Us

There are hundreds of recent forum and articles of this all over the net, and not being racist but so far i've only read two counts of a white driver being in the front car...

Man i'm so mad at the Solicitors i've got the letter, just have visions of going down and smashing it on the front desk *RWOOOAR* going gym in a sec vent my fury

There's a stupid number of accident claim adverts on the Asian network channels (if you have Sky have a look).

Think I saw it mentioned on Roads Wars and Slough, the place where I work was mentioned.

Thing is though, just because there appears to be nothing coming, the car in front can still legitimately stop for no good reason, maybe they saw something you didn't, or the situation changed, people really ought to keep an eye out for this because while this lot probably are scammers they are exploiting a common driving error that people make and the best course of action is to not make the error.

I accidentially did this to someone a few years back on Ainley Top roundabout in Huddersfield. I'd been sat in a queue on the A55 waiting for the roundabout, reached the give way line and when a gap came I decided to go, unfortunately it was dark and that roundabout is covered in trees and as I was entering some little car emerged from behind the trees at about double what I would consider to be a safe speed for that roundabout, straddling both lanes. I stood on the anchors and the idiot narrowly missed my front bumper. Then some old guy in a Renault Scenic went straight into the back of me just as I was lifting off the brake pedal about to have another go.

And yes it did cause an injury, I was looking right at the time and was pushed forward quite hard, even today I still have trouble with the muscle that runs up the front/left side of the neck. It'll occasionally go twang and start hurting like buggery.

Hi Guys,

Got a bit of an update, today my wife informed me that on Friday somebody from the insurance is coming round to interview us both (individually apparently) to try and get the full picture.

The advisor (apparently the guy who is coming out) says what i've said all along and that something "doesn't add up" and he wants to check fully into this guys background and will be contacting our witnesses in due course

We asked about the situation and if the claim is dropped and seemingly if the evidence is quite damning against him, the Solicitors and his insurer normally will drop the claim within 48hrs. Hope he gets whats coming to him!

So fingers crossed. I'll post back Friday/Saturday with the updates

For once, it is nice to hear that you've done pretty much everything advisable - call the police at the time, get witnesses, update the police, let the insurers know, etc. If there's any justice, it'll go your way and they'll get done for fraud.

What a pain for you.

Once you had heard the witnesses say they had seen him do it previously, you could have claimed he reversed into you. Let him prove he didn't.

Sounds like a right ol' load of twaddle, the solicitors, doctors and driver must all be in on it...or indeed the same person!

There are not necessarily any clinical signs of whiplash, it can be diagnosed on history and reported symptoms alone.

Ive heard of this scam happening in my area. It involves 2 cars, one pulls along side you and gets your attention and then the car in front brakes hard. The car at the side then acts as a witness for the guy in front.

Hope it all goes OK for you. Sounds like you have done everything right and have been lucky enough to have a witness.

a lot of these are targeted at HGV's and truckers have to be on the look out for situations that you describe, its a tough one for us, if your doing 30 MPH with 44tons behind you and some **** decided to slam on the anchors for no reason infront of you, he is going to out brake you no matter how fast your reaction.....

and if you leave a sensible gap, some clown will drive into that gap, so youll have to slow down more, then eventually you may as well just stop

Don't talk rot. It's perfectly possible to drive leaving sensible gaps, sometimes people will pull into them, but they barely cost you any time when they do.

not if they cut you up and then slam on the brakes.

most times i leave a healthy amount of space between me and the car in front, it will usually be filled by some numpty, and that's in a car. i can only imagine that this happens a lot more when driving an HGV

do you actually drive? other cars will be in the gap in front of the lorry in no time

where do you live? id love to live somewhere with considerate drivers

The highway code does not teach you to only watch the car in front, or to make sure that you have enough space to stop should the car in front do something entirely random and unpredictable...
