Totally correct. If need be, pick up a leaflet in the branch with the DD guarantee and the banking code to prove your point.

The bank must refund all charges also.

There's your problem right there. Halifax are without doubt the worst bank in the country for trying to rape people with charges.

they are refusing to give back the money saying it between me and the company, ive phoned the company and they will refund any charges inccured, ive sent them the bank letters. Seems that halifax are abunch of money grabbing.
 
Get your money back then change banks.Don't forget to write a stinky complaints letter to head office.

I have never had any problems with them (touch wood) they have always been really good with me even when I had money problems after getting ripped off by Easyjet, now there is a bad company!
 
Nope they are still charging me £105, however the other company said they'll pay the charges. Halifax are refusing to, they still charged me and will not refund the money.
Spent 3 hours there, and they cant even suspend it went to another bank.

What did they say when you mentioned the DD guarantee? You're not going to leave this are you?

iam tomorrow, they said that the fees would remain in place, because there wasnt the money to pay the DD, and the DD guarantee only works if the money was taken out and no money was. i told them i had no DD with that company so i should NOT have been fined, they didnt care, i phoned the company and the Cs guy spoke to the bank told them it was an error bank still going to charge me the company then told me they'll have to reimburse me the fees.

ive taken all my money out of my account and my other account, going to abbey to open an account tomorrow.

just seems the banks are going for it, never ever had a DD fee now because of an error iam being charged and other DDs are failing because of the charge.
 
Some people need to better manage there financial side of things.

A Direct debt can be viewed/checked/deleted etc via online banking.

Anytime you setup a DD you should always check online that it has been set up correctly to confirm there are not any problems later.

Also if 1 payment screws up everything else you should try to keep some money in the bank at least to cover any problems - which in your case has happend.

As Acidhell had been saying on the previous page in some respect, learn to manage your own **** better.

DD and Random said company will always make a mistake, it is how it is, at least you can always be on top of things and stop/correct it as soon as you spot something (rather than when **** hits the fan and its to late).

Also take Burnsy's advice and follow this through! You might learn a lesson from this.

So there isnt any reason to have funds to cover it. the blame is with the bank and the company, iam getting a refund and then take either bank or the company to court for access funds that they were not allowed too.

You are too quick to blame me, i had no idea about this, everything was fine, if i am not informed then how am i supposed to know. its like saying when you ve had your card cloned or money taken out of your bank account that you should have kept an eye out.

my finances are always rock solid, it other that make the mistake.

To some extent you are right but also wrong. You stated you asked the company to cancel the DD. This is incorrect, it is your responsibility to cancel the DD at your end. I recently paid off my 12 months interest free with Clode Retail Finance and they actually reminded me at the end of the call to ensure that I cancelled the DD as it could still be taken in error if not otherwise cancelled.

You may of course be covered by the law in which case you will hopefully get it sorted but YOUR money is YOUR responsibility to entrust it fully to someone else without at least tracking it is foolhardy.

Do you 'think' the company cancelled it and then resubmitted it or did YOU actually cancel it with the bank and they have then resubmitted the original? If the latter has occured then I would be looking at fraud proceedings. If it was the former, they probably never cancelled it.

Most importantly, did you check it had been cancelled? As in check online as to what DD or SO are attached to your account? If not then my points above stand.
