Pretty normal practice. But you have full warranty with it. Might be worthwhile seeing if the memory chips are higher rated for more clocking than a standard card.

Crazy stuff, does ATI know something about fermi that we don't?

No, we all know its not coming for another 2-3 months, at least, they don't have A3 silicon yet, retail chips will be A3, we quite literally know they can't have retail quantities of chips for a minimum of 8 weeks, if A3 taped out tomorrow basically which isn't likely.

We might see early A2 benchmarks/launch with no cards available mid Jan, but even that might not be likely.

Other than that, Nvidia have been the kings of selling pre-overclocked cards for ludicrous amounts more for years. I really hope ATi card vendors don't start selling like 4-6 different versions of the same card like Evga/XFX and others do for Nvidia cards. One overclocked for those who don't give a crap is fine, but as for the past decade, buying pre-overclocked cards is madness, unless its got a very decent cooler on and is basically only the cost of said cooler extra.

I agree, the only pre-overclocked card i've owned was the 4870 toxic which was bought for the low noise levels of the cooler. Was wanting the 5870 vapour-X until i saw the price and said no chance. In the USA it's $10 more than the stock one but here it was going for about £70 more before the price increase came into effect.
