Man killed wife 'during a dream'

I fail to see the point of putting the guy through this court case on top of everything else he's suffered when even the prosecution admit they don't want him to be found guilty. What are they expecting to achieve?

Proper justice? Avoiding copycat murders? It's unfortunate but we have the rules for a reason and they need to be followed at all times, otherwise they wouldn't be rules.
 
Well they have to try and make sure he's innocent - or, as the article says, its sets a precedent for copycat killers who might think "ah, a convenient excuse, that other guy got off with virtually no bother".
 
The jury was told that neither sleep expert would go into details about the condition because they did not want details of it being made public in case of "copycat killings".

I don't understand. I just looked AUTOMATISM up on Google. It's, like, in the public domain already.
I'm totally unsure why the CPS has decided he should be, at worst, found Not Guilty due to Insanity (that is the Defence's job to suggest that, isn't it? Don't the CPS trust the jury to reach the 'right' verdict? Isn't that what a 'trial' is for?).
I'd have thought, not being any kind of legal expert, that Manslaughter with Diminished Responsibility sits better.
I think there is more to this. What does the wife's family think, for example?
 
I saw this program before about 'night terrors' where people would do terrible things, but whilst sleep walking

At first you just think 'bs', but after seeing the show, I really felt for all involved :(

Yeah man it sucks. I've woken up by my room door after crawling there, as in the dream I was suffocating and was trying to escape to find help. It's not pleasant, I feel for this guy.
 
If he is found not guilty by reason that gives the courts the power to keep him in an mental institution at their leisure.

Er, yeah I know what it means. I was just pointing out that he is already innocent if they don't give the Jurors the guilty option.
 
I can't get my head around having such a ridiculously convoluted trial, where they've limited the possible verdicts and denied vital evidence being given which could persuade the jury one way or the other.

A part of me wonders, is this not a subconcious acting out of what they really want to do. You can have a world reknown piano player forced into it by his parents, its his career now but he hates it, but also can't force himself to walk away due to the money so subconciously he sabotages his career. What if he did want to kill her when awake but couldn't work up actually doing it but his subconcious let him do it.

Impossible to prove either way to be honest and its a shakey area and those were just examples I was giving, didn't see the program, don't know if the piano guy really wanted to quit but hadn't told anyone nor that this guy might have wanted to kill his wife.

But half the reason for finding him not guilty would be intent, but what if he did intend to kill her, just not like that and then?

Either way, a trial where they can't find him guilty and can't hear all the evidence is nothing more than a farce.
 
Suffering from a sleep disorder, I totally empathise. My other half has woken before just as I was about to knock the living **** out of her. Thing is, I have some amazing tablets to fix it so no worries now.
 
Night Terrors, It's a horrible thing to suffer from...

I have suffered with it for most of my life, and yes i've flipped out in my sleep towards my wife, but NEVER to that extent...Also, when there is Night Terrors, there can also be Sexomnia...lol, which isn't the best thing to have either...I have quite a lot of issues while sleeping lol...
 
I have had "night terrors" woke up and ran out the housing looking for a burglar, this was 3am and I was in my boxer shorts and my sister woke me up outside and I stood their for 3 minutes not knowing what I was doing.
 
Manslaughter charge. Mitigating circumstances dictate his sentence should be reduced if he is able to proove his sleep disorder in a sleep lab. He won't get off scott free thats probably the best you could hope for.
But I expect they'll just slap a murder charge on him and shove him in prison to die.

Though to be honest I think I'd just kill myself, poor bloke, thats really awful
